Freedom of Information Act 2000 – request for information
I refer to your email of 28 December 2014 in which you asked for the fol owing
“Please could you supply me with the name of the Director of GMC Legal
with a copy of the structure chart for that current organisation”.
I have now considered your request in accordance with the Freedom of
Information Act 2000 (FOIA).
Please find enclosed a copy of the structure chart for our legal department. I have
included the names of those staff graded at GMC level 3 and above. Anthony
Egerton is currently Assistant Director of legal services and reports directly to
Anthony Omo, our Director of Fitness to Practise. To clarify there is no individual
with the job title of Director of GMC Legal.
Some information has been withheld or redacted within the enclosed structure
chart. This is in respect of staff graded at GMC Levels 6-4 and personal information
about the individuals concerned. I consider this information to be exempt from
disclosure under the FOIA. The exemption that I believe applies is:
Section 40(2) by virtue of Section 40(3)(a)(i) – Personal Information.
This relates to information requested which is about a third party, and the
disclosure of which would be in breach of the Principles of the Data Protection Act
1998 (DPA). In this instance we consider that the disclosure of this type of
information would breach the First Principle, which requires that the processing of
data is fair and lawful. We consider that the conditions in Schedule 2 of the DPA
relating to the processing of personal data are not met, therefore the release of the
information you have requested would be unlawful.
You do have the right of appeal against my refusal to supply al the information
you original y requested. If you wish to appeal please set out in writing your
grounds of appeal and send these to Julian Graves, Information Access Manager,
at the address provided above.
You also have a further right of appeal to the Information Commissioner. If
required, Mr Graves wil provide the relevant contact details.
