Dear Requester

Re: Request under the Freedom of Information Act 2000 (the Act)

The Authority has considered your request which was received on 1st December 2014
and our response to your questions is shown below.

1)  “Since the Taking Control of Goods (fees) Regulations 2014 came into force,
has Nottingham City Council handed any  monies which a debtor has paid
directly to the authority in respect of his or her council  tax liability to its
enforcement agent? If so, how much and in how many cases?”

Since the Taking Control of Goods (fees) Regulations 2014 were introduced monies
paid to the Council are handed onto a bailiff in the following circumstances:

a) The payment fully settles the debt with the bailiff including their fees. In this case
the value of the fees is passed to the bailiff;
b) The debtor clearly indicates that the payment is for the bailiff.

To date we have passed 37 such payments onto a bailiff for a sum totalling £4,131.
This compares to £8.3m of debt referred to the bailiffs this year.

by contacting this office.
