I am writing to make an open government request for all the information to which I am entitled under the freedom of information act. In order to assist you with this request, I am outlining my query as specifically as possible. If however this request is too wide or too unclear, I would be grateful if you would contact me asI understand that under the act, you are required to advise and assist requesters.

1. Please advise me under what contractual agreement/arrangement were works awarded to G. Griggs & Sons, Inveresk Mills Industrial Park, Musselburgh, EH21 7UQ, by the Property Conservation Department for Statutory Notice works carried out at the above subjects.

2. Please provide a copy of the Tender Report List for the above works.

3. Please provide a breakdown of the items including rates and quantities used for producing the Probable Cost/Tender Document.

4. Please provide the date of order to the above named contractor in document form.

5. Please provide a copy of the flat roof warranty.

Should you feel that it would assist me please feel free to include any other correspondence in relation to the above contract.

Environmental Information (Scotland) Regulations 2004  Manifestly
Unreasonable

 

Thank you for your request for information.

 

Unfortunately, we are not going to provide you with the information you
have requested. We consider that your request falls into the category of a
‘manifestly unreasonable’ request under regulation 10(4) (b) of the
Environmental Information (Scotland) Regulations 2004 and we are not
obliged to respond.

 

The Council has received over 170 requests relating to the same subject
area and has evidence to suggest that you are working in concert with
other individuals. We consider that to request information in this manner
imposes a significant and disproportionate burden on the Council. We
calculate that it would take approximately 340 hours to respond to the
requests submitted by yourself and others at a cost in excess of £5000.

 

This regulation also requires the application of the public interest test.
While there is a clear and understandable public interest surrounding the
operation of the Council’s Property Conservation Service, I am of the
opinion that the public interest is better served by ensuring that Council
is able to undertake its normal programme of work.

 

Please note that this letter constitutes a formal refusal notice under
regulation 10(4) (b) of the Environmental Information (Scotland)
Regulations 2004.
