I am writing to request an internal review of Cabinet Office's handling of my FOI request '2022 Platinum Jubilee Civic Honours Competition - Wrexham'.

You have failed to state which element of section 35 you have identified is exempt under section 35. Is it 1(a), 1(b), 1(c) or 1(d). As you mentioned protecting government policy making i will presume its 1(a).

The government policy to award City Status to the winner of the competition is already well implemented. Nothing in the document that i have requested could possibly have any influence on government policy. Therefore i do not believe that section 35 is engaged in this case. B, C or D also do not appear to be relevant in this case.

I request that the document i have requested is released with immediate affect.

I am writing to request an internal review of Cabinet Office's handling of my FOI request '2022 Platinum Jubilee Civic Honours Competition - Wrexham'.

FOI Reference: FOI2022/02617

You have incorrectly applied section 35 (1)(a) to class my request as exempt information. Section 35(1)(a) applies only to the formulation and development of Government information. Nothing contained in the information that i requested could possibly influence the formulation of Government policy. The policy to award city status to the winner of the competition is already well established.

The ICO in its guidance on section 35 states:

"To be exempt, the information must relate to the formulation or development of government policy. The Commissioner understands these terms to broadly refer to the design of new policy, and the process of reviewing or improving existing policy.

However, the exemption will not cover information relating purely to the application or implementation of
established policy. It will therefore be important to identify where policy formulation or development ends and implementation begins"

The information that i have requested merely relates to the implementation of established policy and so cannot be exempted by means of section 35.

As you have no legal grounds to rely on section 35 please release the information that i have requested.
