2021 - 2023 Flooding incidents
Dear Yorkshire Water Services Limited,
Under the EIR regulations, I would like to request the following information.
For the duration of 2021, 2022, and 2023, in Excel format: a full list of flooding incidents your organization has been made aware of. For each incident, please provide:
- the date
- the location including post code (to the best extent possible under GDPR)
- whether it is sewer water or clean water
- whether any compensation was claimed
- whether any compensation was awarded and how much
- whether it is internal to a person's property, merely their garden, or outside private property
- the cause of the incident. (Please clearly mark those incidents where it has been deemed that the incident is your company's fault, not your fault, or unclear.)
- the length of the incident
- the depth of the flood

The Yorkshire Water Services Ltd Data Protection Team acknowledges your

We will respond to your request for information in compliance with the
Environmental Information Regulations 2004.
The Regulations allow us 20 working days to respond to a request from the
date of its receipt. However, occasionally it is necessary to extend the
20-working-day time limit for issuing a response if the complexity and
volume of the information makes it impractical for us to respond within
the original deadline. If this is the case we will notify you of this
delay.
You will be informed in advance if there is a charge for supplying copies
of the information. We will also provide you with an explanation if we are
unable to disclose and respond to your request. If the requested
information contains references to any third parties, we may need to
consult with them before deciding whether to release the information.

Any incident reported to you where water has penetrated an individual's property, whether garden or internal.

Clean water is non-sewer water.

Dear Louis Ramirez,
I refer to your request for information submitted to Yorkshire Water dated
9 December 2024, thank you for the further clarification that you provided
in the 20 December in relation to your request.
Please see the attached data which you have requested.
We can confirm that we do not hold the length of the incident, as such for
the purposes of paragraph 12(4)(1)(a), a public authority may refuse to
disclose information to the extent that (a) it does not hold that
information when an applicant’s request is received.
In relation to the location data when reviewing the information that you
have requested, we are satisfied that the information amounts to personal
data and should not be disclosed under Regulation 12(3) and 13. We are
satisfied that the disclosure of the information you have requested in
relation to this would allow the identification of an identifiable
individual(s). Secondly, disclosure of this information would contravene
principle a, of the Data Protection Act 2018 and GDPR, as there is no
lawful basis for this processing. Based on this we will not be able to
provide all the location information to you. We have provided the town and
partial postcode area.
Curtilage external flooding is defined as flooding within the garden or
curtilage of a building, that may be residential, public or a business.
Non curtilage is external flooding to public areas and open spaces,
agricultural land, car parks, footpaths and highways etc.
In regards to column D, any reference to ‘none sewer water’ is any
incident not related to a YW sewer, this could be private assets, clean
water or surface water runoff.
In relation to compensation there are guaranteed standards (GSS)
compensation payments for internal and external sewer flooding. For
internal sewer flooding where the criteria is met these payments are made
automatically by us to the customer with no need for them to claim. For
external sewer flooding the customer claims the payment. Where a GSS
compensation has been paid the column headed “GSS Value” will show the
amount of compensation paid in relation to the incident. Where this field
shows Empty Property this means that the incident met the criteria for a
GSS payment but that no payment was made as the property was empty at the
time of the event. Where this column shows “Not Claimed” that means there
was an external event but that the customer did not claim a payment.
Where the column shows “N/A” this means that no GSS payment was due either
because the responsibility for the incident was “Non Yorkshire Water” or
the responsibility for the incident was “Yorkshire Water” but it did not
meet the criteria for a GSS payment.
