I am writing to request an internal review of Kent County Council's handling of my FOI request '2020_01January_17 Inhabitant of a County'.

i would like to receive clarification on the following answer as a review.

My Question 1::
1)Would you please provide the recorded information that you may have that defined what an Inhabitant is?

This is not information held by KCC.

Definition of Inhabitant from a google dictionnairy.
An Inhabitant of land is defined as: Please go to this link to confirm that.
inhabitant
plural noun: inhabitants
a person or animal that lives in or occupies a place.
Similar: resident, occupant, occupier, dweller, settler, local, native, population, populace, people, public, community, citizenry, folk, townsfolk, townspeople, denizen, burgher, residentiary, habitant, oppidan, indweller ....
a person who fulfills the residential or legal requirements for being a member of a state or parish.

My Request for Clarification on Question 1:
Now that you have been made of a common definition of Inhabitant and the similarity what is your answer to question 1.
A) Furthermore, have you got any inhabitants on your land?
B) What would happen if someone who lives in your land regards or/and describes himself as an inhabitant, do you accept that he or she is one of the people occupying your land and therefore who he/she said he is?
C) Is this definition of Inhabitant legally acceptable for your organization is not please provide your own recorded definition or confirm that you accept this one.

Your answer to question 4 makes this response disingenuous. would you please define these two terms and then tell us what their different rules are:
A) County Council.
B) Borough Council.
C) What is the difference in duties between these two when it comes to the liability of the inhabitant?

Your Response 3:
Kent County Council is not a Borough Council; therefore, this is not applicable.

My Request for Clarification on Question 3:
Your response shows that you must know the difference between a Borough Council and a County Council. Therefore you being dishonest in failing to respond to question 2.

4) Would you please provide recorded information regarding the contacts details
of your County Council

Having thoroughly reviewed your request and the subsequent response from
Kent County Council, I would like to respond to each of your queries in
turn:

 

Question 1 -

Response

As explained previously, this is not information that is held by Kent
County Council in a recorded format.

The Freedom of Information Act 2000 provides a right of access to recorded
information held by public authorities like Kent County Council. The Act’s
provisions do not provide any rights of access to thoughts, opinions,
comments or interpretations, unless they have already been physically
recorded in some way. Neither does the Act oblige public authorities to
create information or obtain it for you from other sources (for example
Internet search engines). Therefore, KCC cannot respond to your question
because it doesn’t already hold the information you have requested and is
not obliged to give you an opinion.

Question 2 -

Your answer to question 4 makes this response disingenuous.   would you
please define these two terms and then tell us what their different rules

liability of the inhabitant?

Response

Again, I am afraid this is not information that is already held in a
recorded format by Kent County Council.

The link that was previously provided will take you to a resource that
explains how Borough and County Councils function in England and what
different responsibilities they have. Depending on where you are based
geographically in Kent, it would be worthwhile to take a look at the
website for your Borough Council to see if they might hold the information
you seek.

Question 3 -

Your response shows that you must know the difference between a Borough
Council and a County Council. Therefore you being dishonest in failing to
respond to question 2.

Response

I do not find that Kent County Council has been dishonest in its response
to your original question; the response was correct in stating that this
information is not held in a recorded format by Kent County Council and
signposted you to an online resource that would be helpful in answering
your query.

Question 4 -

I could not see a complaint in relation to Question 4, so have not
responded accordingly.

Question 5 -

Please clarify your position on this question.  

Do you accept the common definition of inhabitant and therefore answer the
rest of the questions.

Response

This is not information that is already held by Kent County Council in a
recorded format.

Taking into consideration the points above, I am not able to uphold your
complaint, as there is no further recorded information that Kent County
Council is able to provide in respond to your questions.

I trust that this explanation now satisfies your complaint. However, if
you are still unhappy, you can appeal to the Information Commissioner, who
oversees compliance with access to information legislation including the
Freedom of Information Act 2000, Environmental Information Regulations
2004, Data Protection Act 2018 & General Data Protection Regulation.
