Thank you for your reply.

The delay seems to be an ongoing thing for most of this year including data protection requests. I understand your email however I will make an official complaint to the ICO if a response is not given by the deadline, as I do also believe a fleet list would be easily accessible and saying “the ICO is aware and we’re enacting a recovery plan” isn’t a get out of jail free card.

This request is now overdue. Do you know a rough time I can expect to receive the information I’ve requested?

Any further delay and I may need to go to the ICO; as previously stated by myself that simply copying and pasting a message about the ICO and enacting a recovery plan for the last few months isn’t a get out of jail free card. I will look to take the matter further.

However I do sympathise with the forces situation, I’d appreciate the information ASAP.

I am writing to request an internal review of Northamptonshire Police's handling of my FOI request '2019 Fleet List'.

My request was made on the 5th of may. The law states you must provide a response within 20 working days. It's now been almost 2 months. I have complained to the ICO and they have let me know i first must complain to yourselves.

I can confirm that your request was received on the 7th of May 2019 and acknowledged on the 20th May 2019. The due date given for this request was 5th of June 2019. The data has been requested and is being considered for release.

Northants Police is working through a backlog which has been created by an increased demand in requests. We are working through this backlog as quickly as we can. No requests have been refused due to this backlog. You will be provided with a full response in due course.

Today is the 9th working day following the ICO’s letter to Northants Police FOI Unit requesting a response within 10 working days. With tomorrow being the deadline I’m just seeing if the information is ready to be released yet, as when I spoke last to a manger over the phone, I was informed it was just being checked for released and any private information redacted (VRM’s for unmarked Vehicles). Like I said tomorrow is the ICO’s enforced deadline and if this isn’t met, I will look at taking further action with the ICO and exploring my legal options.

I am writing to request an internal review of Northamptonshire Police's handling of my FOI request '2019 Fleet List'.

I requested ALL vehicles on Northamptonshire Police’s fleet list. This has not happened; Firearms’s vehicles have been excluded with the reasoning about undermining security and if people knew the forces resources, could use it to plan crime or attacks. Frankly I believe this to be unwarranted. I could go out right now and film every single firearms vehicle while they’re out and about or at open days etc and make them public. Whether it’s done through members of the public spotting them or via a fleet list, the result is the same.

A lot of traffic cars are also missing and other vehicles I’ve even seen myself are missing, such as 2 Volvo V70, a few Traffic XC70’s, a BMW 530D G31 and more. I haven’t received a reason as to why about this, so could that be looked into please?

No unmarked vehicles have been included but again I haven’t received a reason (unless it’s covered by specialist vehicles). Today in the space of 5 minutes I seen 3 unmarked police cars responding and caught them on dashcam. I could upload that footage and have the same result as a FOI. Many other forces also release this information and just redact the station it’s based at and VRM.

It also seems other vehicles have been removed such as dog units, and some have either incorrect or old divisional names (eg according to news releases, TST was renamed / changed yet on the fleet list, vehicles still show as belonging to that division. On top of that I asked for a current fleet list. NO 19 plate vehicles have been included although I know they exist.

The ICO demanded a response was given within 10 working days and that deadline ended today. I will be further contacting them while this internal review is underway.

Where I have referenced other forces FOI responses for fleet list, please check West Midlands Police, West Mercia Police, Metropolitan Police, Merseyside Police etc. This can be easily done via the website www.whatdotheyknow.com . In fact, even check your own fleet list from last year or the year before, which included all vehicles bar unmarked.

Thank you for your email requesting an internal review of Freedom Of Information request 2975/19.

I have assessed the data that has been disclosed and the exemptions that have been applied for any data withheld. I have also noted all the points that you have raised regarding the response that you have been provided with.

Having carried out my review I can confirm that Northamptonshire Police have provided the data that is appropriate to be exposed to the world at large under the Freedom Of Information Act 2000 and protected data that is sensitive, including unmarked vehicles, by providing a Section 31 exemption along with a public interest test applied to it.

In addition to the response provided under FOI and in relation to your original request, I will respond to some of your comments and questions outside of the act.

You state that some of unmarked vehicles can be spotted at public events and the details could be taken by members of the public and shared with others. I agree that this can happen however it is also the case that vehicles spotted in isolation and then details shared with others holds a far lower risk than providing a snap shot list of all vehicles on hand at any given time.

I have looked at the list in relation to the vehicles that you have specifically identified. Both V70 and XC70 are listed. I have been unable to identify the BMW that you have referred to.

You refer to the use of incorrect divisional terms. How we refer to teams and divisions and record them on our systems are specific to the force. How we as a force choose to refer to divisions publically does not always mirror our in house recording.

At the time your request was submitted I can confirm that there were not any 19 plate vehicles on the Northamptonshire Police fleet list.

Your request was for the fleet list at the time of your request. This is what has been provided. Due to the nature of vehicle use by any police force, the vehicles available to the fleet can change. It is also the case that police vehicles spotted in any county may not be the property of that particular force, this could be due to collaboration, regional services or cross border investigations for example. Please also bear in mind that some vehicles are provided on loan to forces for test use but are not the property of the force. Unfortunately it is also the case that members of the public use market available goods to give the appearance of being a police vehicle. Therefore it is the case that not all vehicles on the roads of Northamptonshire that appear to be police vehicles are police vehicles or part of the Northamptonshire Police fleet.

Lastly I would like to advise that each force has different reporting systems and each force accept differing levels of risk. To this end comparisons cannot be drawn between how different forces respond to the same request. There is no requirement for us to refer to the websites of other forces to enable us to make our own response, however I accept that this will be of interest and use to you.

I trust that my response and review provides you with some additional clarity.

Thank you for your reply.

I struggle slightly to understand the difference between manually going round and recording the details of vehicles to build a list and just having a list given to me. The results are exactly the same however I’m awaiting the advice of the ICO.

I’m regards to divisions and vehicles, I understand the bit about divisions and that makes sense, however some divisions that are listed don’t even exist anymore? Eg the public and internal name of one division is Safer Roads team - I know this as I know the sergeant. However in the fleet list only 2 of their vehicles are listed and it’s down as casualty reduction?

Missing vehicles - I’m sorry but on this one, you’re wrong. For example, Road Crime Team have a Volvo V60 (or V70, I always get them confused) D5, and I’ve checked the plate from photos on twitter and it’s not listed on your fleet list. I also have been pulled over by officers in a unmarked White BMW 530D G31, and I know it was Northants as they identified themselves as such and I seen their ID.

Can I please confirm if this is the last of the internal review so I can refer back to the ICO?
