2017 Library Statistics

Hello. I have two requests that shouldn't be much trouble.

1. Could you answer if the library service or local authority completes annual CIPFA library stats. These are as detailed here:

2. If the answer to the above is Yes, please could you send your 2017 CIPFA library stats return (covering financial year 2016/2017)?

It is important that this should be sent in the exact format (a copy of the same file) that is sent to CIPFA.

To try and pre-empt any concerns about this request, there is no reason why the authority should not be able to also supply this data to third parties as well as CIPFA. It's subject to Freedom of Information, without exemption, as it is data that is compiled and held by the authority.

There are many examples of previous Freedom of Information requests for this data. Only one seemed to be rejected, by Derbyshire County Council, based on their belief that it was exempt as it would be possible to obtain these from CIPFA. This was clearly wrong though, and was overturned on appeal by the Solicitor for the Director of Legal Services in that Council.

Dear Barking and Dagenham Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Barking and Dagenham Borough Council's handling of my FOI request '2017 Library Statistics'.

The request was refused on the grounds:

"It will be published in due course by CIPFA and at this point we will be more than happy to provide you with the return sent to them, but until this date we are not able to share that data as it must be validated by CIPFA.

The data needs to be validated by CIPFA and will be available to share in January 2018. "

This exemption request is a little muddled. It stated two things, that you're waiting for a third party to validate the data (not part of the exemption), and that it will be published in due course by CIPFA.

The second part is using the rules of FOI that state an exclusion is possible, if the information is intended to be published in future. That's not actually correct though, everything CIPFA does with the data, from the point that the authority submits it to CIPFA (in July) is then the business of CIPFA. The data is not intended to be published, it is to be used internally by CIPFA and CIPFA subscribers.

I do not believe that an internal subscriber system, for whom the data will indeed be made available, can possibly count as publishing under exemption rules.

On the first point, that CIPFA is validating the data, there is no reason for the authority to wait for a third party to validate their own data before publishing it. Validated data by CIPFA will also belong to CIPFA.

I'm requesting the data that this authority collected, and is publicly owned.
