Under section 21 of the Freedom of Information Act, a public authority is
not required to provide information that is reasonably available

Dear Royal Borough of Kensington and Chelsea,

I am writing to request an internal review of Royal Borough of Kensington and Chelsea's handling of my FOI request '2015/16 Pension Fund Investment Data as MS Excel File'.

Please note that the request clearly specified that the information/ data requested be produced in "MS Excel format" in order to permit ease of information reuse under "datasets" provisions of FOIA https://ico.org.uk/media/for-organisatio...

As RKBC in its response has linked to a PDF document uploaded to the Councils website for the purposes of year end reporting, satisfies neither the requested format of the original FOIA request, nor guidelines encouraging authorities to provide information in specified formats permitting ease of reuse.

Whilst RBKC has invoked section 21 of the Freedom of Information Act stating a public authority is
not required to provide information that is "reasonably available elsewhere." RBKC has not taken account of the fact that the information available online on the Council’s Website is in PDF format, not the prescribed format which was Ms Excel.

As requested, please provide the information requested as Ms Excel output, and I would strongly encourage you to add an Ms Excel document download option for your pension fund annual reporting - in order to avoid repeat FOI requests for this information in future.

It is worth noting that in excess of 80% of LGPS funds have freely provided this information upon request in the prescribed Ms Excel format - and well within the 20 day FOIA timeframe.
