I am writing to request an internal review of Home Office's handling of my FOI request '19th December, 2018'.

The Freedom of Information Act clearly states information or other valid response must be provided within twenty working days. Please provide your internal review of the failure along with the information originally requested.

In the case of the latter it would be acceptable for you to refuse to provide the information but then go on to state something equivalent to HM Treasury who told us the Chancellor was having Christmas drinks but that was in his role as MP rather than the Chancellor. We feel that's splitting hairs but they apparently do not.

Dear Home Office,

Thanks for your message.

The ICO encourages compromise yet you were unwilling to engage.

You failed to expand on your 'refusal' as HM Treasury was able to do even though you were provided with this information in advance. We suggest whatever law allowed them to do so applies equally to yourselves.

As a result of your failures we have had no choice but to pass this matter onto the ICO.

Dear Home Office,

I am writing to request an internal review of Home Office's handling of my FOI request '19th December, 2018'.
The ICO has asked us to request a second internal review of this matter [FS50866320].

Your previous response ignored the second element to our previous internal review request. If a refusal is made to release information, for example citing 'information is personal' it should be accompanied by some clarification of the refusal. The authority is obligated to follow Section 16 and Provide advice and assistance.

Again, we remind you this request was also put to HM Treasury who also initially responded with a refusal to provide the information citing 'personal'. However they followed their duty under Section 16 and other applicable ruled and informed us what this this meant. They informed us it meant the individual in question was engaged in having Christmas drinks BUT in his role as MP rather than as Chancellor.

We expect The Home Office to follow the same rules as HM Treasury followed in the example provided above. We require clarity.
