Dear Jared,
Thank you for your e-mail of 22 January regarding offences resulting in dismissal from the RAF.
You requested the fol owing information:
“Firstly I would like to know the official list of offences that result in immediate dismissal from the RAF.
Secondly I would like to know between the time period of 1st July 2010 – 1st July 2013 how many RAF
personnel were dismissed due to the above mentioned criminal offences list.”
I am treating your correspondence as a request for information under the Freedom of
Information Act 2000 (FOIA)
We have completed a search of our records and I can confirm that no information within the
scope of your request is held.
Under Section 16 of the Act (Advice and Assistance) you may find it helpful to note that there is
no official list of offences that result in immediate or automatic dismissal from the RAF. The
circumstances of each conviction are considered by senior officers on a case by case basis
before any decision to dismiss is taken. However, conviction for any offences covered by the
Sexual Offences Act will normally result in the individuals being dismissed or asked to resign
their commission. Likewise, individuals convicted of offences attracting a custodial sentence
from a civil court will usual y not be retained by the RAF.
If you are not satisfied with this response or wish to complain about any aspect of the handling
of your request, then you should contact me in the first instance. If informal resolution is not
possible and you are still dissatisfied then you may apply for an independent internal review by
contacting the
Deputy Chief Information Officer, 2nd Floor, MOD Main Building, Whitehal ,
SW1A 2HB (e-mai
l xxxxxxxxxx@xxx.xx). Please note that any request for an internal review
must be made within 40 working days of the date on which the attempt to reach informal
resolution has come to an end.
If you remain dissatisfied fol owing an internal review, you may take your complaint to the
Information Commissioner under the provisions of Section 50 of the Freedom of Information
Act. Please note that the Information Commissioner will not investigate your case until the
MOD internal review process has been completed. Further details of the role and powers of
the Information Commissioner can be found on the Commissioner's website,
http://www.ico.gov.uk.
Yours sincerely
