Dear CST Finance FOI (Corporate Services and Transformation),
In that case please pass this letter onto Paul Stone acting as S151 Officer within Derbyshire County Council.
Please also Confirm the points raised in the letter as to how derbyshire county council operates in respect of council tax and summons for council tax?

[email address] 27th Day of January 2023
Derbyshire County Council, [email address]
County Hall, Matlock,
DE4 3AG

To S151 officer Paul Stone within Derbyshire County Council

Please provide evidence that you have that I am under obligation to pay by providing me with a copy of the legally valid contract which includes a) Full disclosure b) Equal Consideration c) Lawful Terms and Conditions and d) Mutual Consent (signed by both parties).

I am happy to receive a summary from the Magistrates Court as long as it is:

Not a bulk processed order
On the legal proper court form (hence No barcodes) which:
Has the official seal and undersigned by the Clerk to the Justice of the Peace with a wet ink signature
Following the procedural rules according to Section 1 of the Magistrates Court Act 1980 whereby a case file will be created and a case progression officer assigned to the case.

On receipt I will contact the Magistrates Court requesting a Data Subject Access Request to see a copy of the case file. May I remind you of the Data Protection Act 2018 (Section 173) (3) - it is an offence for a person listed in sub section (4) to alter, deface, block, erase, destroy or conceal information with the intention of preventing disclosure of all or part of the information that the person making the request would have been entitled to receive.

Regarding liability orders, according to the Council Tax Handbook ,13th Edition:
The form (the Council Tax (Administration and Enforcement) Regulations 1992 UK Statutory Instruments
No. 613 SCHEDULE 2 Form A ) originally provided to draw up liability orders was removed from Law on 1st October 2003 in England and no form has been substituted in its place.

The Local Government Act 1888 - Section 78 (2) states:

Provided that the transfer of powers and duties enacted by this Act shall not authorise and county council or any committee or member thereof - (a) to exercise any of the powers of a court of record or:
(b) to administer an oath or:
c) to exercise any jurisdiction under the Summary Jurisdiction Acts, or perform any judicial business, or otherwise act as justices or a justice of the peace.

So I can therefore assume that it will be the Magistrates Court with a Magistrate who will be acting under his/her oath (otherwise I would be quite happy to highlight sections of the Administration of Justice Act 1970 (Part V) , the Perjury Act 1911 and the Fraud Act 2006 )

Without prejudice UCC1-308
No assured value. No liability. Errors & Omissions Excepted. All Rights Reserved

Yours sincerely,

Leonard of the Harpin family
