13 Weeks since appeal is allowed

We're waiting for FAISAL IIQBAL to read recent responses and update the status.

Dear Home Office,

I made an application for ILR on the basis of my 10 years long residence at Croydon PSC in November 2016, which was refused on 16 May 2017. I challenged the HO decision and my appeal was allowed on 19 January 2018 by the FTT. I have also received the implementation letter from the HO dated 31 January 2018.

My solicitor, MP and I have written to the caseworker on different occasions and requested for the return of my travel documents due to the nature of urgency. I want to travel urgently due to my mother’s health being very critical. I have also provided the caseworker with the evidence showing my mother’s current health and that she is admitted to the hospital. My mother who is currently in the hospital for past many weeks in Pakistan suffering from a serious heart condition and require an urgent heart surgery, which is not possible without me as I am her only legal guardian. I am under huge stress due to mother’s health. I request you to please help on this matter.

My formal questions to you:
1) What is the service standard processing time of a BRP after the appeal is allowed and not challenged by the Home Office?

2) What should I do in my situation as it has been 13 weeks since the appeal is allowed and I have not received my travel documents/BRP despite the situation explained above?

It is with regret that I have not yet received a response from the Home Office to this request as of today. I should be grateful for an explanation as to the delay in responding to the request and a timeframe for when I can expect a response to my request.

If I do not receive a substantive response to my request by tomorrow 19 June 2018 (being 40 working days following the date upon which the Home Office received my original request), I shall be writing to the Information Commissioner seeking a decision as to whether the Home Office have complied with the requirements of section 10 of the Freedom of Information Act 2000 in respect of this matter.

My appeal was allowed in January 2018 by the FTT and was not challanged by the Home Office. I made a request to the Home Office in February 2018 for the return of my travel documents urgently as my mother who was seriously ill with heart problems and required surgery which is not possible without me. I also have provided the evidence of my mothers medical report and letter from her doctor showing the status of her health to the Home Office on several occasions. My local MP has informed the Home Office four times and made them aware of my request. My solicitor has written to the Home office (case worker)four letters requesting them to please return my documents but didn’t get no reply. I also made a request here but no one contacted me as yet.
My mother who was critically ill with serious heart diease is now on the ventilator and taking her last breath waiting for me. I am traumatise with this whole situation and this all effecting my health everyday mentally. I don’t know any other way where I can write or request to return my documents. I request you please return my travel documents as I cannot travel without my passport. Please for the sake of humanity retun my documents so I can at-least see my dying mother one last time. Its been nearly six months I am requesting on every possible forum for the return of my documents but getting no answers. Please look into this matter urgently.

I am still waiting for someome to contact me and to update me as to why my travel documents are not returned after my appeal was allowed in January 2018 and not challanged by the Home Office. I also have provided enough evidence to show the health condition of my seriously ill mother. Further to our conversation earlier over the phone please see below the reason I am requesting for the return of my documents urgently.
