I am asking for an internal review of my FOI request as I do not believe this answers the questions fielded.

Your response states it 'would not be easy to do' in relation to the determination of where individuals detained under Sec.136 were taken.

This is not a reason under the FOI Act for refusing to provide the information.

The attached spreadsheet does not answer my question. I have asked where were the detainees under Sec.136 first taken..

You have provided a list of hospitals and wards and occasionally a field called 'released'. This is unclear and doesn't answer the question.

can you explain in simple terms at the point the individual was held by police, were they first taken to the custody suite and then sent to the locations you have stated?

Or

Upon detention in the street by the police were they immediately taken to the locations you have specified without first being taken to the custody suites at one of Bedfordshire Police's stations?

You asked where individuals were taken following detention and we provided the information based on the wording of the question, i.e. where were individuals transferred to following detention.

As such I have logged this as a new request from 07 January 2014, with a reference number of 2014-00079.

Each record will need to be manually checked again to try and ascertain the information you require and as there are many hundreds this will take some time, but we have started working on this and I will try to get back to you as soon as I can.

Thank you for the further information. However the latest figures seem to cause conflict with the first set of figures you provided, namely the amount of arrests under Sec.136 of the mental health act.

You have now specified that there are in;

2008 - no figure
2009 - 141
2010 - 180
2011 - 132
2012 - 127
2013 - 177

Yet prior to this I was given figures of Sec.136 detentions as being;

2008 - 36
2009 - 42
2010 - 72
2011 - 95
2012 - 111
2013 - 84

As you can see, if the latest figures are correct, in that Police detained individuals under Sec.136 and then took them directly to a medical facility, the numbers provided previously must be incorrect.

Further, you have provided a figure for those initially taken to custody prior to transfer. This number is 167, yet you have not identified what year(s) these are distributed across. Would you please remedy this.

As explained in the response letter, the figures you originally received and have referred to below as Sec.136 detentions are the number of arrests on the custody system where the first arrest reason has been recorded as S.136 Mental Health Act. For your subsequent request, we then had to manually check all of those records which had a disposal method of MHA Diversion to ascertain where they were transferred to and then manually check them again to advise whether they at any point went to custody, or if they went straight to another location.

When processing your last request which asked us to advise the number that did not attend custody at all, we were advised that people who are taken straight to a S136 suite are not required to be recorded on custody. This meant that by just checking the records that have been recorded on custody we were not providing a full picture. Therefore, we have also provided you with information not held by us, but recorded by the NHS mental health team to try and give a more accurate reflection of the numbers that attend custody and those that don't.

In regard to the distribution of the 167, please see the table below:
