Subject: Initial Notice for flats at 12 The Ridge Way, South Croydon CR2
0LE

Your request is being considered and you will receive a response within
the statutory timescale of 20 working days, subject to the application of
any exemptions. Where consideration is being given to exemptions the 20
working day timescale may be extended to a period considered reasonable
depending on the nature and circumstances of your request. In such cases
you will be notified and, where possible, a revised time-scale will be
indicated. In all cases we shall attempt to deal with your request at the
earliest opportunity.

If we are unable to provide you with the information requested we will
notify you of this together with the reason(s) why, and details of how you
may appeal.

Request FOI/8026

Further to your request received on 07/08/2023, I confirm that the Council
has now considered your request under the Environmental Information
Regulations. Specifically, you have requested the following information:

 

"Please provide a copy of the Initial Notice from the Approved Inspector
(20/02419/IN ) relating to the erection of 9 self-contained flats at 12
The Ridge Way, South Croydon CR2 0LE, which was deposited with the Council
on 17 December 2020.

Please note, this information CANNOT be obtained using the Council's
search facility and therefore Regulation 6(1)(b) does NOT apply.

An earlier request that shows that the Council has disclosed initial

By Regulation 12(2), the authority must apply a presumption in favour of
disclosure, in both engaging exceptions and carrying out the public
interest test.

The information provided should be redacted ONLY as required by
legislation. Please note, I do not challenge the withholding of any
PERSONAL names, email addresses and/or telephone numbers etc that the
information might contain."

The names and identities of individuals on these attachments has been
redacted, as this would be disclosing personal data to you; withholding of
personal data as defined by Regulation 12 (3) and 13 of the Environmental
Information Regulations. 

Regulation 12(3) says:

(3) To the extent that the information requested includes personal data
which the applicant is not the data subject shall not be disclosed
otherwise than in accordance with regulation 13

Regulation 13 says:

13 – (1) To the extent that the information requested includes personal
data to which the applicant is not the data subject and as respects which
either the first or second condition is satisfied.

13.—(1) To the extent that the information requested includes personal
data of which the applicant is not the data subject and as respects which
either the first or second condition below is satisfied, a public
authority shall not disclose the personal data.

The first data protection principle states processing of data should be
fair and lawful. As there is no expectation to release third party
names into the public domain unnecessarily, we are satisfied in this case
that such information should be redacted.
