Please disclose a copy of your policy for compliance with the Statutory Reporting Duties of Terrorism Act 2000.

You should shortly have a copy of an FOI to Northern Ireland Office availed to you through Cllr Turpin.

There are questions that your PCC should know the answers to.

(1) In 1992 Met Det sgt Leighton arrested UDA hit men and drugs importers at their Margate Kent base. Two garages they used were searched. Was this the reason inquiry was raised at Sericol into suspected thefts of cyclohexanone a solvent used in back street drugs labs (Ironically to produce PCP) ?

(2) In the course of inquiry a massive contamination of Thanet aquifer by cyclohexanone was discovered in 1993 and water abstraction from the area immediately turned off. I think even now only 5% of Thanet water is locally abstracted. Was there inquiry into the site safety engineer? His arrest 1987 for paramilitary activity within TA, the status of his engineering qualifications and the circumstances in which he left Kent Special constabulary circa 1979 ?

(3) The contamination of aquifer was kept secret from the public until my FOI to Environment Agency 2008. Privy to the truth was the cttee with jurisdiction at Thanet Council on which sat a cllr (Sericol site safety engineer) and a colleague who later joined Kent Police Authority as a County Cllr.

(4) In 1996 Ken Speakman was murdered in Ramsgate. A member of the now notorious 6th Thanet Gun Range. The Parole Board submission related to this murder can be availed to you via Cllr Turpin. You should study this.

(5) My information is that in 1998 there was further inquiry into the status of qualifications used to secure work as a Sericol engineer. This inquiry would have coincided with inquiries called for by REME Corps Secretariat via MOD Police into whether REME Records, used by an associate to gain Reliance security work at Deal Royal Marines Barracks, were forgeries.

(6) In August 1997 Sir John Grugeon Chair of Kent Police Authority had called for inquiry and report. But Chief constable would not comply. When you study the material you will see that Kent Police were in fact case compromised from conducting Lawrence Inquiry.

(7) In May 1998 there was a High Court libel hearing in which the newly unemployed Sericol engineer former cllr former arrested paramilitary, former Special constable was found guilty of libel. His cllr colleague and member of Kent Police Authority allagedly gave evidence. Allegedly telling High Court on oath there were no inquiries into the defendant. Which on the face of it appears to be multiple perjury given there were EA inquiries, inquiries called for by HM Coroner, Inquiries called for by Kent Police Authority and inquiries called for by REME Corps Secretariat and an EU resolution of 1990 on member states which also called for such inquiry.

(8) During her time as Chair of Kent Police Authority there was Standards Complaint against that High Court witness Cllr member. Will you disclose your PCC's account to you of how the Standards Process at KPA was conducted ?

(9) You will understand that if the High Court Judge had been told the truth in 1998 many of the questions now being asked by Mark Ellison QC Review would have been asked WHILE Kent Police were conducting Lawrence Inquiry.

(10) This is not a trick question. If you have knowledge subject of statutory reporting duties or subject of Misprision of Treason then you commit an offence if you remain silence (The situation your PCC has indulged since she first joined KPA in 2001) You have a duty to oversee your PCC. hence you have a duty to ensure she acts in compliance with the law. IE You have a duty to ask her for a FULL explanation.

The Police and Crime Panel does not have a policy for dealing with
compliance with the Statutory Reporting Duties of Terrorism Act 2000.

 

With regards to the remainder of your e-mail, you appear to be requesting
that the Police and Crime Panel undertake an investigation into a range of
matters going back for some years. The Police and Crime Panel can only
hold the Police and Crime Commissioner to account for matters connected
with her formal role from the time she took office and in accordance with
the legislation governing the roles and responsibilities of Police and
Crime Panels, not before.

Thank you for your prompt reply.

This is a public record site and so I try to write FOIs that are informative to the public of the reasons I seek public funded time and effort to provide responses.

I will notify Lord Carlile QC (who was independent reviewer of terrorism law for ten years). Universities have guidelines but district councils like Thanet do not. And neither it seems does the Police and Crime Panel.

Last year, whilst Ms Barnes was PCC, she was made aware of report to Lord Carlile and his opinion that it is NOT conspiracy theory. She was also aware of Office of Nuclear Safety being requested to make a retrospective inquiry at Dungeness A into a report of historic unreliability and possible sabotage of the emergency shut down backup generator(s). This information was availed after report to Lord Carlile. Reported to Lord Carlile and to ONS and Ann Barnes.

She has also been made aware that following conviction for historic rape of a six year old girl (28 year sentence handed down January 2014) that efforts are being made to establish whether or not the Parker twin paedophile mercenaries were amongst those subject of the 1994 Desmond Tutu Commission of Inquiry. IE Allegedly prepared and despatched to attack Mandela Regime from THANET. Where then recent arrests by Met had occurred of UDA drugs importers and hit men. Specially relevant to bear in mind is the history Armscor and Apartheid Regime in South Africa arming UDA via UK state collusion agent Brian Nelson.

All she has done is refuse to answer any correspondence and to cravenly hide behind silence. In my view she had a clear range of statutory reporting duties under Terrorism Law re firearms, ranges, paramilitary training and concerning civil nuclear security. Failure to report (In this case to Met the lead counter terrorist force and to Dyfed Powys post 9 11 inquiry) would be an offence carrying five years.

Your Panel duty is akin to the Attorney General. He has an overriding duty to the Queen (sole fount of justice) to ensure the govt does not break the law. there is a principle that we cannot break the law to enforce the law. Hence to Ann Barnes there are situations in which the law makes it an offence to be silent (Money laundering proceeds of crime, terrorism and Misprision of Treason).

You have a duty to ensure that your PCC obeys the law in the conduct of her duties. Hence your Panel should question Mrs Barnes and, if necessary, through knowledge acquired discharge their own duty by reporting (To Met and Dyfed Powys and ONS)

The role of the Police and Crime Panel is to hold the Commissioner to account, who in turn holds the Chief Constable to account. So, no, the Panel does not have a strategy for compliance with the Statutory Reporting Duties of Terrorism Act 2000, as this is not within their remit. However the Chief Constable may have such guidance so I suggest again that you contact Kent Police.

Thank you for your further reply. I copied the first reply to Lord Carlile QC.

Misprision of Treason and Statutory Reporting Duties of Terrorism Law are not suspended by "Remit".

The fact is, in the course of your duties, you acquire reportable knowledge. A failure to report is an offence carrying five years imprisonment.

If you are holding a PCC to account who holds a Chief constable to account in reportable matters then the reporting duty cannot be discharged by reporting back to the Chief constable ! In the Kent history reports needed to be made to Met Counter Terrorism unit and to Dyfed Powys Police.

Last week, for your information, IPCC emailed me to ask how Kent Police were compromised to conduct Stephen Lawrence inquiry. IE About the failure of Kent Chief constable to comply with a call, for inquiry and report, from its own police authority.

As later Chair of KPA and as PCC it is alleged that Ann Barnes has contravened Terrorism Law in order to sustain the Kent Police cover up.

Without compliance with Terrorism Act reporting duties it is impossible that you can fulfill your remit of holding Ann Barnes to account.

Thank you for your answers. We have a situation in which universities have a compliance policy. Charities Commission has an umbrella type compliance policy. But the closer we get to the front line the less likely it is that an awareness, of Defence of the Realm measures, will be embedded.
