Wrongful distress by council bailiffs
Dear The Local Government and Social Care Ombudsman,
Under foia can you confirm the answers you have given in the past related to
If a councils representatives have wrongfully distressed goods .what is the common expected redress?should the redress come from the council or the 3rd party
Would you say the council or the third party are negligent
Would you say it is of good practice to ask a director under mental health care to sign a indemnity after a wrongful address stating you will not sue ?
Would you expect the goods to be returned at the bailiffs cost?
Should the the bailiff should inform the council of the reasons why levy failed and why redress took 3 months?
the bailiff and agent should be interviewed?
the audit should be presented to the councils contract division
redress of ? should be made
how many cases of wrongful redress/excessive levy did the ombudsman receive in 2010 and 2018?
