INTERNAL REVIEW STAGE.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Dunchurch Parish Council's handling of my FOI request 'Written Resignation of Cllrs. Thompson and Knott'.

It is my belief that a reasonable interval has passed since my previous request for the same information and I can expect a full answer to the present request.
The use of private emails for Dunchurch Parish Council business has up to now not been questioned. The practice does not give such emails exemption from the provisions of FOIA.

"FOIA Section 14(2) Where a public authority has previously complied with a request for information which was made by any person, it is not obliged to comply with a subsequent identical or substantially similar request from that person unless a reasonable interval has elapsed between compliance with the previous request and the making of the current request.”

Mr Waller,

Please find attached the emails received in relation to the resignation from
Cllrs. Thompson and Knott, as previously provided to you on 16th November
2020.

As also explained in an email to you on 17th November 2020, some areas of
these emails were redacted due them being personal in nature and the
releasing it would be contrary to the UK General Data Protection Regulation
(GDPR), this includes:
- The email address that Cllr Thompson sent her resignation from as this was
a personal email address. We are unable to comment on why Cllr Thompson used her
personal email rather than a DPC email.
- Comments made by both Cllr Thompson and Knott which contain information
that would fall under the Personal Data as set out within the GDPR.

A referral to answers given last year does not constitute a response to the current request.
I believe the claim to exemptions under G.D.P.R. is not applicable to FOIA. Specific exemptions should be applied.
The fact of public body business being conducted with private personal email addresses is a consideration.
