I've got an email that says the areas have no rates for damage works and will not have. Why's this and what's the difference in rates now Kier have got them?

The situation with regard to the Authority's contracts is as follows:
Highways England have two main maintenance contract models in use:
1. the original Asset Support Contract (ASC), which is in the process of being phased out and replaced with
2. the Asset Delivery model (AD).
In the former contract model, a schedule of rates is included.
This should be used as the basis for the calculation of costs for claims above and below the £10,000 threshold. As we have long explained, these 'base rates', DCP Rates or 'defied costs' are to be common to all claims in ASC Areas. But they are not.
Below threshold claims are presented to drivers, fleets, hauliers and insurers but they are compiled using a much higher set of rates. In Area 9, Kier Highways have not complied with the contract since day-one, 07/2014 as a cost of £millions to those unfortunate to receive one of their state-supported demands.

We consider that this question has been addressed previously. For the avoidance of
doubt, we confirm that the Asset Support Contract contains the mechanism to
produce a Defined Cost. The model Conditions of Contract for Highways England
Asset Support Contracts (ASC) is publicly available online

The term ‘Defined Cost’ refers to a definition in the contract which can be found in
clause 11 at point (27). The Defined Cost is calculated in accordance with the
definition. The contract does not contain a schedule of Defined Costs as the
mechanism sets out how the Defined Cost is calculated.
''Why are there no rates schedules?''
The Asset Support Contract operates a target price with a pain/gain share is used by
Highways England for most scheme work. The target price mechanism is not used
for Green Claim repairs following challenge by insurers who were not prepared to
accept any pain/gain approach in their payment of claims for damage repairs from
negligent drivers.
There are rates contained in the contract i.e. the Pricing Schedule that are used for
determining the target cost as part of this pain/gain share mechanism. The Pricing
Schedule, including Appendices A, B and C, contain the rates tendered by the
provider. These rates are exempt from disclosure as the conditions under section 43
of the Freedom of Information Act 2000 are met. This was recently upheld by the
First Tier Tribunal in an appeal against the Information Commissioners decision
(reference EA/2018/0104).
As stated in our previous response there are no rates contained in the contract, or
held by Highways England, that are used in the calculation of the repair costs for
damage caused by third parties to the strategic road network.
The majority of TP repair works are involved in an emergency response which is
determined by the nature, scale and urgency of the incident and repair, and
consequently the repair costs are a bespoke calculation related to need.
Such unplanned work tends to be far less efficient than planned repair work (for
which in our Asset Support Contracts there is a contractual Schedule of Rates) and
hence will be costlier. The Schedules of Rates specified in the ASCs are not used to
work out the Defined Cost, or for assessing the reasonable cost, of repair in respect
of such TP claims.

costs in areas 6, 8 and 9 are determined under this contract. The other areas have
separate contracts and the costs are determined in accordance with the relevant

A larger incident is more costlier than a smaller incident because the hours associated with the larger are more - the event does not dictate the cost of an operative, plant or materials. You are being misled.

I got an email saying your document is wrong

You have been sent a CBD (Cost Breakdown Document) that is used by Kier when they bill Highways England. You will note there are various columns:
Hours / Quantity
Base Rate Charge
Overhead %
Subcontract %
Total Cost
This evidences how Kier is not complying with the contract in Area 9 . But the document has the heading 'below / over threshold' and therefore it may be intended to mislead Highway England and you.
This is NOT the CBD used BELOW threshold.

You will note:
There is no 'overhead %'. Why not? Why is the cost displayed as a single charge? Why is a Third Party on a sub-threshold claim unable to identify the 'cost' and 'uplift'? Could it be to assist exaggeration? Why have a separate CBD for Third Parties when you have a document that could be used and purports to be for over and under threshold?
Also, the under-threshold CBD at the above link has another column - charge rate. This is used to charge a multiplier to a Third Party if the operatives, for example, AIW, works after 5pm of a weekday. The uplift is:
1.5x after 5pm
2x weekend
Kier tells us and Courts they pay this to their AIW's because they work 8am to 5pm weekdays. However, AIW's say they work shifts, are not paid the uplifts and event overtime is at a flat rate. So why the charge to Third Parties? Why not a charge to Highways England - not even the facility for it?
Possibly because HE and TP should be paid the same base rate of about £24 and he gets charged 8% uplift (approx.) whereas a TP should be charged about 26% uplift i.e. about £30 / hour for an AIW? The above link shows £73.05/hour ... how do you get to £73.05 / hour by adding 25% to £24/hr?
The CBD you have been sent is headed 'Prepared for illustrative purposes only in response to FOI 770,527' - so who prepared it and why the indication is it used below-threshold?
Note the column 'base rate' - nice to see ... but whose base rate? where does this come from and who checks it?
Highways England says they have no schedule of base rates. Odd, there is a column clearly for them.
The document reinforces that base rates should be the same to HE and a TP but they are not.

What have you sent me? Send me an example of a claim on the same day below and over the threshold so I can compare.

You have not received an explanation for the use of the 'definition'.
In Area 6&8 the contract is an ASC. The base rate or defined cost to Highways England (HE) and a Third Party (HE) should be the same.
the compilation of the charge should be the same to a TP & HE - the total is the same.
you then need to know what uplift ('fee' to HE and 'TP claims overhead' to a TP) is being applied.

‘Claims below threshold under our ASC contracts are pursued directly by our Service Providers. We do not hold, nor does our contract require, the provision of individual claim date and cost data which would allow us to correlate, capture and present claims to meet your request. We therefore cannot provide you with an example of below and over threshold claims that occurred on the same day. This request follows a number of requests made by you about third-party claims. In addition, you have made several requests in relation to the contracts in Areas 6 and 8’

I question the accuracy of the information you have received. I refer you to

there is a requirement for contractors to send claim information to Highways England. Furthermore, if the Authority needs the data, they only need ask Kier Highways for it.

It is important to be aware Areas 6&8 are an ASC that has Appendix A to Annex 23. This means the base rates or ‘defined costs’ to Highways england and Third Parties are to be the same. They are not.

The equation is simple: base rate (£) + uplift (%) = maximum charge to a TP

Kier Highways have never complied with the contract though they state to the contrary. Highways England (coincidentally) failed to publish the process and have not ensured the process was complied with despite being aware for years. To tis day, it is not adhered to.

The uplift is fixed for a contract. As charges to a TP have remained constant to TP’s for months, if not years, it follows IF the process were being complied with, the base rate has remained a constant. Otherwise, it follows that Highways England have failed to ensure the public they are to serve are protected.

It is evident Kier Highways are working to a set of rates. It is these you need and as they are held in behalf of the Authority by Kier, they should be available. The http://www.englandhighways.co.uk/false-i... is straightforward:

TP’s are being charged about £65/hr for an AIW and £36/hr for their vehicle

HE are being charged less than £30/hr for an AIW and £15/hr for the vehicle. The highest uplift I have seen is Kier in Area 9 @ 25.29%.

You tell me how, from £30 / hour you get to £65/hr, by applying about 25%. This on 1,000’s of claims.

If you see a multiplier on an AIW’s rate, likely 1.5x after 5pm of a weekday and 2x of a weekend, ask for evidence they are paid this. 21/06/2017 we conveyed this to Highways England in person, documented. Kier Highways claim AIW’s work 8am to 5pm weekdays, that they do not work shifts and after 5pm are paid 1.5x, of a weekend they are paid the 2x uplift – this has also been stated to a Court. The Authority has bene provided access to the Court transcripts to support this.

AIW’s state they work shifts, that they are not paid the uplifts and even overtime is at flat rate. So how would you describe 100’s of claims for these uplifts that see an AIW charged at about £100/her of a weekday after 5pm and £130/r of a weekend when Highways england are not charged these uplifts?

I am not surprised you are encountering difficulties. The reference to ‘vexatious’ is also noted – but just who are the vexatious arty; those who have sought the information – over 175 requests / reviews have apparently been received by HE about DCP Rates, or Highways England who failed to state., from the off (in response to the first request) DCP Rates were not held but just the opposite; the rates are held but commercially sensitive.

It is evident much of what you have been asked has not been addressed and I will attempt to explain @ www.englandhighways.co.uk asap.

If you are still after rates in Area 9, I would suggest you ask Highway England to provide you with an event on the following dates, to populate the CBD draft they have sent or provide a CBD on their file from the event:
