Freedom of Information 2000 /Environmental Information Regulation request
2004 F14160

We have now considered your request for information as set in your email
below. Please see attached documents. There are 49 attachments in total
and the rest will follow in an additional email.

Please not that the personal information (names and contact details) has
been redacted as this is considered the personal information of the
individual and exempt from disclosure under Section 40(2) of the FOI Act.

In addition some information has been exempted from disclosure under
section 43(2) of the Act.

This exemption applies to information where disclosure would be likely to
be prejudicial to the commercial interests of any person.

Disclosure of this information would be likely to prejudice the council’s
commercial interests, because it relates to issues regarding the funding
of the project. Release of this information may damage the reputation of
both the Council and the NHS, affecting the ability of the both to
negotiate the best value future contracts and funding for future projects.

As section 43(2) is a qualified exemption, we have gone on to consider the
public interest test. We accept that there is a general public interest in
openness and transparency to promote accountability. In this case the
public interest in maintaining the exemption outweighs the public interest
in disclosing the information.

If you are dissatisfied with the handling of your request or wish to
appeal against the decision to exempt any part of your request, you should
