Who signed off the risk assessments?

Dear Plymouth City Council,

During the summer of 2015 Plymouth City Council voted on the imposition of the “Fairer Charging Tax”.

Would you please provide minutes from the meeting and the names of all the Councillors who voted for or against the imposition of the Charge.

Would you please confirm that individual Risk Assessments and Equality Impact Assessments have been completed and endorsed by the committee, and made available to all Council members before voting for this policy?

Would you also provide evidence that all of the Councillors who voted for this Policy have read and understood all of the details of the individual Risk Assessment and the Equality Impact Statements?

This will require a list of the Councillors names that were responsible for endorsing this charge and their corresponding signatures.

Dear Mr Gilbard,

Thank you for your request for information dated 16/06/15 and received on 16/06/15 concerning Vote on Fairer Charging Tax.

This request is being handled under the Freedom of Information Act 2000.

This letter is a full response to that application.

Your request was to be supplied with information regarding the Vote on Fairer Charging Tax.

Carole Burgoyne (Strategic Director for People) submitted a report on Fairer Charging for Non Residential Services to Plymouth City Council's Cabinet on 15 July 2014.

I attach -

(1) the Cabinet minutes of 15 July 2014 from which you will note that the meeting was attended by Councillor Evans (Chair), Councillor Peter Smith (Vice Chair), Coker, Lowry, McDonald, Penberthy, Tuffin and Vincent.

There was no recorded vote. However the Cabinet meeting was webcast and you can view the discussion on the item from the Council's website using the following link http://www.plymouth.gov.uk/webcasts

The Leader at the end of the item states that the vote was unanimous.

(2) The Cabinet report with Appendices A and B and the Caring Plymouth scrutiny recommendations were considered at the meeting and can also be accessed on the website using the following link http://tinyurl.com/ntlkrsd I have attached them to assist you.

(3) The background papers (Department of Health Guidance; equality impact assessment and full consultation response document) which are referred to in the Cabinet report and were published at the same time as the agenda. These can also be accessed using the link on the Cabinet agenda page and I have attached them to assist.

(4) The minutes of the Caring Plymouth Scrutiny Panel on 2 and 3 July 2014 where the Panel scrutinised the proposals over a two day period. Councillor Tuffin attended the meetings as the Cabinet Member with responsibility for Health and Adult Social Care so that the panel could question him and the officers on the proposals.

I can confirm that the agenda and reports were circulated to all Cabinet Members and published five clear days in advance of the meeting in accordance with statutory requirements. The background papers were also published at the same time in accordance with statutory requirements and were able to be accessed by the Cabinet Members.

The published minutes provide the record of the decision taken which are confirmed as a true record by the members at the following meeting.

As with all Council decisions, reports are submitted to the members of the meeting in accordance with statutory requirements, and councillors can seek briefings from officers prior to the meeting. In this case Councillor Tuffin also attended the Caring Plymouth Scrutiny Panel over a two day period.

With regard to individual risk assessments, the officers carried out a detailed review on a small cross section of individual service users to identify any specific issues and this informed the development of the policy. You will appreciate that this information is of a sensitive nature and relates to individual clients.
