Response: This information is exempt from disclosure under section 40 of
the Freedom of Information Act 2000 (personal information) as the
information constitutes third party personal data. In particular, section
40(2) of the Freedom of Information Act 2000 (FOIA) provides that personal
data about third parties is exempt from disclosure if one of the
conditions set out in section 40(3) of the FOIA is satisfied. In this
regard the Council considers that the disclosure of the requested
information would constitute a breach of one of the conditions set out in
section 40(3) of the FOIA, namely the right of a data subject to have
their personal information processed fairly and lawfully in accordance
with the UK General Data Protection Regulations (UK GDPR).
Articles 5 and 6 of the UK GDPR, state that personal data shall only
be collected for specified, explicit and legitimate purposes and not
further processed in a manner that is incompatible with those purposes and
that processing shall be lawful if the data subject has given consent to
the processing of his or her personal data for one or more specific
purposes.
The information provided which the Council holds about Ms Culligan was
provided as part of the recruitment process and would not be provided for
any other purpose.
However public information about all solicitors registered with the
Solicitors Regulation Authority is available through the public record of
solicitors on the SRA website.
If you are unhappy with the way your enquiry has been dealt with, you may
ask for an internal review by submitting a request within one month of the
date of this response.
