When to apply for ILR and which form?

The request was refused by Government Legal Department.

Dear Government Legal Department,

I entered the UK in 2014 through an agent as an asylum due to well-founded fear in my country.
I applied for asylum which was refused, I lodged an appeal which was successful and I was granted 5 years refugee statues. My 5 years run out in September 2019, I applied for my ILR in August 2019.

However, in November 2018, I was given non-custodial convictions for battery due to family issues which was out of my control. Off course, I had to disclose this tot he Home Office Set P application department- which was done.

Just a few days ago, my Set P application was refused but I have been granted 3 years further leave as refugee. What my question is, can I apply for my ILR next years after November as it will then be 24 months past my criminal conviction or do I need to again extend this current (3 years leave) for a further 2 years so I qualify under the 10 years route? For either of the above, which applications do i need to file please?

I would really appreciate your assistance in the above matter.

Yours faithfully,
Anita

Dear Anita

Thank you for your e-mail. The Government Legal Department (GLD) will not be able to answer your questions under the Freedom of Information Act (FOIA) as you are asking for advice and opinion and not for recorded information.
It may be helpful if I explain that the Freedom of Information Act (FOIA) (2000) gives individuals and organisations the right of access to all types of recorded information held, at the time the request is received, by public authorities such as the GLD.

In order for a request for information to be handled as a FOIA request, it must be for recorded information. I have provided the web address to the relevant government website below, you can furnish yourself further with information in regards to ILR.

The GLD does not provide legal advice to members of the public. You may wish to obtain independent legal advice by contacting a qualified solicitor to advise you on how your issue might best be addressed. You can find details of approved solicitors at http://www.sra.org.uk/consumers/using-so...
