When did LCC become aware of Saxton cladding issues?

Dear Leeds City Council,

I would like to make a FOIA request for the following information:

1) The date that Leeds City Council first became aware that construction methods differed between the Drive and the Parade buildings at the Saxton development in LS9.

2) The date that Leeds City Council first became aware that the Parade building’s cladding system at the Saxton development in LS9 was considered high risk.

3) A written statement explaining how Leeds City Council became aware of the above two facts, including who raised the issue, what channel they used and which officer it was raised with.

4) A written copy of any advice given by Leeds City Council to RMG/Urban Splash/Thomasons in 2017/2018 relating to fire safety measures at the Saxton development.

I write in response to your below information requests regarding Saxton Gardens.

I can confirm that these are being considered under the Environmental Information Regulations 2004 (EIR), as opposed to under the Freedom of Information Act. This is because the information you have requested concerns ‘activities’ and ‘administrative measures’ which are likely to affect elements of the environment under Reg 2(1)(c).

Due to the complex nature of your requests, I regret to inform you that we will be unable to meet the deadline originally specified for them (11th December 2018).

Reg 7(1) of the EIR, however, does allow the Authority to extend the 20 working day deadline to 40 working days in the event of such complications and, given the nature of your request, we feel that it is appropriate to do so in this instance.

I would like to reassure you, however, that your request is under active consideration, and that we hope to be able to respond in full significantly in advance of this date.

I trust this is satisfactory. Please do not hesitate to contact me if you require further clarification.

I write in response to your above Freedom of Information request, received
in this office on 8^th January 2019.

 

In dealing with your request, please note that we have considered it under
the Environmental Information Regulations 2004, as opposed to under the
Freedom of Information Act 2000. This is because the information you have
requested is information involving ‘activities’ and ‘administrative
measures’ which are likely to affect elements of the environment under Reg
2(1)(c).  I am advised that both the domestic and European courts give
wide meaning to the Regulations and have indicated that they will adopt a
broad construction of the definition of environmental information.

Your request asked:

 

1)         The date that Leeds City Council first became aware that
construction methods differed between the Drive and the Parade buildings
at the Saxton development in LS9.

 

Leeds City Council Building Control were involved in the site Inspections
at the time of conversion of the 2 blocks and the officers involved will
have been aware that the two construction were slightly different

 

2)         The date that Leeds City Council first became aware that the
Parade building’s cladding system at the Saxton development in LS9 was
considered high risk.

 

Leeds City Council has not stated that the cladding system on The Parade
was high risk.

 

3)         A written statement explaining how Leeds City Council became
aware of the above two facts, including who raised the issue, what channel
they used and which officer it was raised with.

 

N/A.

 

4)         A written copy of any advice given by Leeds City Council to
RMG/Urban Splash/Thomasons in 2017/2018 relating to fire safety measures
at the Saxton development.

 

Leeds City Council does not hold any information in this regard.

 

I trust that this response is satisfactory. Under Regulation 11, however,
you are entitled to make representations to us if it appears that we have
failed to comply with a requirement of the Regulations in relation to your
request. Representations must be made to us no later than 40 working days
after the date you believe we failed to comply with such a requirement.

 

We will then consider your representations and supporting evidence and
decide if we have complied, notifying you of our decision as soon as
possible, and no later than 40 working days after the date of receipt of
your representations.

 

Under Regulation 18, you are then entitled to apply to the Information
Commissioner for a decision as to whether, in any specified respect, your
request has not been dealt with in accordance with parts 2 and 3 of the
Regulations.
