Response

 

1.      There is no known relationship between Kate Messenger (the
applicant) and the Council.

 

2.      Regulation 5(1) of the EIR states that a public authority that
holds environmental information shall make it available on request.

 

Regulation 12 states that “To the extent that the information requested
includes personal data of which the applicant is not the data subject, the
personal data shall not be disclosed otherwise than in accordance with
regulation 13.”

 

The exception at regulation 13(1) provides that third party personal data
is exempt if its disclosure would contravene any of the data protection
principles set out in Schedule 1 of the Data Protection Act 1998.

 

The information requested is considered to be personal data.

 

It is accepted that there will always be public interest in disclosure to
promote transparency and accountability of public authorities, greater
public awareness and understanding of environmental matters, a free
exchange of views, and more effective public participation in
environmental decision making.

 

The information held is personal data, and given the reasonable
expectation of the customer and their rights under the Data Protection
Act, there does not appear to be a legitimate interest in disclosure of
their personal data that would outweigh their privacy rights in this case.

 

The release of information following a request under the Environmental
Information Regulations is not just a disclosure to the requester, but it
is a disclosure into the public domain.

 

The weight of public interest is in maintaining the exception.
