Freedom of Information Act 2000 – Information Request

 

I refer to your request for information dated 15 November 2011. In
accordance with the provisions of the Freedom of Information Act 2000, I
have now processed your request.

 

As requested, the information is set out below.

 

Your request:

Q1.      Date of the next tender for the “Collection and Disposal of WEEE
(Waste Electrical and Electronic Equipment).

Q2.      Also a copy of the previous successful tender for the collection
and disposal of WEEE

 

Our Response:

Norfolk County Council does not have any contract specifically for the
collection of WEEE as this is predominantly a Waste Collection Authority
activity.

 

At the County Council Recycling Centres, the contractor makes arrangements
for the recycling of WEEE through an appropriate Produce Compliance
Scheme.

 

Contracts for acceptance of WEEE collected by Norfolk's Waste Collection
Authorities form part of the County Council's residual waste disposal
contracts, which are due to expire in 2015.

 

With reference to you request for a copy of the successful tender(s), this
is refused:

 

Section 41(1) of the Freedom of Information Act 2000 provides an absolute
exemption for release of information if the information was obtained by
the public authority from any other person (including another public
authority), and the disclosure of the information to the public (otherwise
than under this Act) by the public authority holding it would constitute a
breach of confidence actionable by that or any other person.

 

Reason Why the Exemption Applies

 

This decision is based upon the following reasons:-

 

The tender(s) were provided to the Council by third parties on an
undertaking that their content would be treated in confidence, moreover
the content is clearly confidential in nature. The disclosure of
the tender(s) would be actionable.
