I am interested to better understand the outcome of the procurement exercise for the “Legionella Water Sampling” that was awarded to Environmental Scientifics Group Ltd on the 24/04/12 (OJEU Ref: 12/S 79-129447/EN)

To this end, I would be obliged if you would forward to me a copy of the winning tender submission along with all supporting appendices and information.

If any of the documents requested contain any commercially sensitive information, or any other information that is permitted to be withheld under the FOI Act, kindly redact such information (and only such information) and release the remainder of the documents. If you do redact any information, please provide a redaction table listing the redactions and the reason for them.

Your request was received on 7^th October 2015 and we are dealing with it
under the terms of the Freedom of Information Act 2000.

Nottingham University Hospitals NHS Trust (NUH) came into being on 1st
April 2006 and assumed responsibility for the services provided by both
the Queen's Medical Centre (QMC) and Nottingham City Hospital NHS Trust
(NCH).

In some circumstances a fee may be payable and if that is the case I will
let you know. A fees notice will be issued to you, and you will be
required to pay before I will proceed to deal with your request.

You will receive the information requested within 20 working days allowed
under the Act unless the Trust does not hold the information or there is a
reason for it to be withheld. I will write to you in any event.

If you have any requirements regarding the format any information should
be supplied in, e.g. the language to be used, audio, large print and so
on, then please let me know.

Thank you for your request for information about water hygiene tenders.
Your request was received on 7^th October 2015 and we are dealing with it
under the terms of the Freedom of Information Act 2000.

Nottingham University Hospitals NHS Trust (NUH) came into being on 1st
April 2006 and assumed responsibility for the services provided by both
the Queen's Medical Centre (QMC) and Nottingham City Hospital NHS Trust
(NCH).

We confirm that the Trust does hold the information falling within the
terms of your request.

On identifying the information requested it has become necessary to apply
a public interest test as required by the Freedom of Information Act. This
is where the Trust needs to balance the public interest in disclosing the
information against the public interest in withholding it. The Trust’s
Public Interest Test Panel will consider your request.

The Freedom of Information Act obliges us to respond to requests promptly,
and in any case no later than 20 working days after receiving your
request. However when a “qualified exemption” applies to the information
and the public interest test is engaged, the Act allows the time for
response to be longer than 20 working days, and a full response must be
provided within such time as is reasonable in all circumstances of the
case.  We do of course, aim to make all decisions within 20 working days,
including in cases where we need to consider where the public interest
lies in respect of a request for exempt information. In this case,
however, we have not yet reached a decision on where the balance of public
interest lies.

In your case we estimate that it will take additional 20 days to take a
decision on where the balance of the public interest lies. Therefore, we
plan to let you have a response by 24^th November 2015.If it appears that
it will take longer than this to reach a conclusion, we will keep you
informed.

The specific exemption(s) which apply in relation to your request is/are:

 

Section 43 (2) 'Information is exempt information if it's disclosure under
this Act would, or would likely to, prejudice the Commercial Interest of
any person(including the public authority holding it'

 

We have also considered that the exemption(s) provided for under
section(s) 43(2) of the Act apply to the information requested.

As per ICO Guidance on s.43 (commercial interests) tender documents
can be released including:

- Tender price & payment terms
- Winning bidders tender document (including method statements as
not trade secrets, but not including detailed financial info, CV's
and referees)
- Winning bidders evaluation
- losing bidders tender docs - non sensitive only
- Info relating to contract negotiation

In addition im trying to understand the accountability and
transparency in the spending of public money. In the light of it
being a Water Hygiene tender im concerned about the public
safety.
