Dear Epping Forest District Council,

Please provide the following data, under FOI:

1) Waste and recycling schedules for all properties, organised by address and postcode. Please include day of the week and collection frequency (weekly, fortnightly etc) for each service type. I request that all data is provided in CSV or Excel format, ideally with separate columns for the different parts of the address. A link to a web service does not meet my requirements: I need the source data. Please include the UPRN for each property if held. This is now permitted by the AddressBase licence. Variants are acceptable if they contain the requested data. Separate spreadsheets for each waste or recycling type are also fine.
2) For collections that are not weekly, details of how to work out which week a collection will be. For example, if a "Week 1/week 2" system is used, then please provide an example of a date in week 1 and a date in week 2. For example "2nd January 2017 was in Recycling Week 1"
3) Details of all alterations to regular schedules for bank holidays etc. Please provide this for all future dates in 2017 and 2018. For example, see this spreadsheet: https://docs.google.com/spreadsheets/d/1...

With regard to our FOI response on 18^th July 2017.

 

We have today received clarification from Ordnance Survey regarding their
policy on UPRN sharing:

 

Based on this clarification we were in error when we included address
detail in the data extract we supplied to you as we should have supplied
the property UPRN only.  For permission to use the addressing element of
this dataset you will be required to obtain a reuse licence from Ordnance
Survey.

 

If you do not intend to obtain said licence, we have attached a
replacement dataset that excludes this addressing element and ask that you
replace our original data supply with this one.

 

It is our understanding that Ordnance Survey will be contacting you with
further information.

Hello Tracy,
The data is no use to me without the addresses. If you need to leave off anything, then it would be the UPRN that is optional as far as I'm concerned. In fact, most of the UPRNs in the original data were corrupted in the export from Excel. The addresses themselves shouldn't be OS copyright, as they come from your LLPG, were generated by you, so are authority owned data. It's questionable whether the UPRNs are either, because you will have been the ones that allocated them, however that's not a battle I want to fight right now! Can we agree that I remove the UPRN from the data but keep the addresses?

To remove all doubt, please can I make an official request to re-use the data under the RPSI regulations. The dataset I am requesting is the original CSV file, minus the UPRN column. Please can you grant permission for reuse, ideally under the Open Government Licence. My planned use is to transform the data into a standard format and aggregate it with the data from other authorities. I will then release it under an open licence to enable the development of useful services to encourage recycling, such as chatbots and voice tools to find upcoming recycling days.

Please see our response:

 

For clarification I attach the communication we have received from
Ordnance Survey. 

 

Unfortunately contrary to your suggestion, our addressing dataset was
originally derived from the Royal Mail 'Postal Address File' and
subsequently OS Addressbase, therefore it is subject to licensing
restrictions.

 

Our position therefore remains that we are unable to allow you to reuse
this addressing data without permission and licensing from Ordnance
Survey. 

 

I'm sorry this doesn't meet your requirements, and I'd suggest you contact
Ordnance Survey directly if you wish to discuss further.

OK, I'll wait to hear from the OS. As you already supplied the full data I won't be appealing this response, but can you please still process the RPSI request. I'm happy for you to wait until the OS has made a decision before you respond. Just so you are aware, depending on the response from the OS, if you will only supply it with the UPRN and not the address I will need to make a request for your authority owned LLPG data so that I can cross-reference with the UPRN myself.

Mr Kane,

I have just spoke to one of our officer regarding your RPSI request. We are unaware of this and what the rules ar. Could you please clarify this point.

At this stage I have to reiterate that EFDC addressing data is used under licence from Ordanance Survey. We cannot provide addressing data until we are advised otherwise by OS.

Dear Tracy Watts,

I'm referring to the Re-Use of Public Sector Information Regulations 2015, as well as the amendments to FOIA that incorporate the same principles. They state that you must allow your data to be re-used under an open licence which by default should be the Open Government Licence. It does not compel you to release information that would be withheld under an FOIA exemption, with the important exception of section 21. Information held by you but also available elsewhere should still be released by you under an open licence.

Regarding the addressing data, I am referring to your Local Land and Property Gazetteer, produced by you as part of your public duty and provided by you to Geoplace LLP as part of the terms of your data cooperation agreement (DCA) with them. Under the DCA you retain the copyright on the original data. I'm not referring to the PAF data from Royal Mail, nor to AddressBase data provided to you by OS, although the latter is based on your LLPG data. It is only the external data provided back to you that contains third party IP. Your GIS officer or LLPG custodian should be able to help with this.
