Warnings on HMRC wrongdoing penalty/duty demands
Dear UK Border Agency/Border Force,
when excise are goods are seized by your officers at the border from cross-border shoppers (either after a full interview or simply take up the option offered by your officers of simply walking away), your officers do not warn shoppers who have had their goods seized that HMRC will demand a wrongdoing penalty/duty demand of £164.11 per kg of tobacco. Similar demands are issued for cigarettes.
Why do your officers not warn cross-border shoppers who have had their goods seized of the HMRC wrongdoing penalty/duty demand?
ls there any guidance/policy that you issue officers in regard to informing cross-border shoppers of these HMRC demands? lf so, what is this guidance/policy?
Your officers do however warn cross-border shoppers that should they appeal the seizure (NOC), they will face court costs in the region of £2500 should they lose the appeal.
