In response to your request officers have provided the attached documents and following information:

1.Redacted Contract Agreement attached. (Doc 13a)

2. The winning bidder was Silverstream TV Ltd

3.£6,300 plus VAT

I have not supplied all the information you requested, some has been withheld under Section S43 of the Act as this relates to Commercial Interests. This exemption is qualified.

Some of the exemptions under the Act are absolute, and some are qualified. The qualified exemptions are subject to the public interest test.

Once it has been determined that a qualified exemption applies, the authority is required to decide whether the public interest is better served by maintaining that exemption and withholding the information, or by disclosing it. The public interest can cover a wide range of values and principles relating to the public good, or what is in the best interests of society. The public interest does not mean what is of interest to the public, or the private interests of the requester. The matters which were considered in applying the public interest test here were as follows:

The rates (unit costs) and some details of the Company's policy information which were tendered by the Company have been redacted. Releasing this information may have an impact on their ability to competitively tender future works for Wiltshire Council and others. It may also assist other bidders on future Wiltshire Council tenders and may even incite collusion between tenderers. None of which are in the interest of Wiltshire Council and we therefore would consider this specific information within the agreement as being commercially sensitive under S43 of the Act.

Factors Supporting Disclosure
•The general purpose of FOIs is to enable public access to information
•Disclosure would help maintain a sense of democracy and public participation

In coming to that conclusion, the public interest in making the information available against any prejudice to the public interest that might arise from providing the information has been carefully weighed.
