Dear Finance.FOI Requests,

Thanks for the reply. Do you think you could send the predicted grades of each student that received an offer, and whether they are from an independent school or not? This is still for V500

Yours sincerely,

Shreena Patel

Finance.FOI Requests, University College London

Dear Ms Patel

Apologies for the delay in responding to your request.

We have completed the compilation of information in response to your
request for the predicted grades of each student that received an offer
and whether they are from an independent school or not.

We can confirm that we do hold information of the description specified in
your request, however to provide you with the requested information would
mean providing you with individualised data, i.e. information by
applicant.  Even though the individuals would not be named, if the
information requested were to be linked with other personal identifiers in
the public domain, it would identify the individual.

Personal data and is exempt from disclosure under section 40(2) and (3A)
of the Freedom of Information Act, the personal data exemption. This
states:

“(2) Any information to which a request for information relates is also
exempt information if—

(a) it constitutes personal data which does not fall within subsection
(1), and

(b) the first, second or third condition below is satisfied.

(3A) The first condition is that the disclosure of the information to a
member of the public otherwise than under this Act—

(a) would contravene any of the data protection principles, or

(b) would do so if the exemptions in section 24(1) of the Data Protection
Act 2018 (manual unstructured data held by public authorities) were
disregarded.”

Section 40(2) of the FOIA allows a public authority to withhold
information under the FOIA where (i) the requested information is
personal data relating to someone other than the requester and (ii) its
disclosure would breach any of the data protection principles. The
disclosure of this personal data would not be within the reasonable
expectations of the individuals concerned and it would be unfair to do so;
this therefore breaches the first data protection principle.

As the section 40(2) exemption is an absolute one, there is no need to
conduct a public interest test.

Where we refuse a request on this basis, we would usually suggest that you
amend your request to be for averages instead of individualised
information, but in this case the relevant data on averages has already
been provided in response to your request FOI 019 697.

You are free to use any information supplied for your own use, including
for non-commercial research purposes. The information may also be used for
the purposes of news reporting. However, any other type of re-use, for
example by publishing or issuing copies to the public, will require the
permission of the copyright owner.

If you are unhappy with our response to your request and wish to make a
complaint or request a review of our decision, please email

Review’ in the subject and be marked For the Attention of the Chief
Operating Officer, alternatively you should write to:

If you are not content with the outcome of the internal review, you may
apply directly to the Information Commissioner at the address given below.
You should do this within two months of our final decision. (Please note,
complaints and requests for internal review received more than two months
