Dear Nottinghamshire Police,

It has come to my attention that Nottingham City Council when sending out Notice To Keeper PCN notices which are civil enforcement notices under the traffic management act have the Nottinghamshire Police logo and slogan on the foot of the notice, I therefore ask the following information regarding this.

1) Has Nottinghamshire Council ever sought permission to use the Nottinghamshire Police police logo on a civil PCN Notice To Keeper that is a request for payment of a Penalty Charge Notice

2) If permission has been granted was it under under licence.

3) If permission was granted what date and who sought and authorised the logo to be used on the Notice To Keeper civil enforcement request for payment.

4) Is it legal to use a police logo on a civil enforcement notice requesting payment that is not a police matter but would always be a civil matter.

Yours faithfully,

John McDevitt

Dear Freedom of Information,

1. Section 10 of the Freedom of Information Act ("the Act") requires a public authority to respond to information requests PROMPTLY and, in any event, within 20 working days. Nottighamshire Police has chosen to break the law rather than disclose the requested information.

2. There is no explanation for the delay and no apology. That is discourteous, unprofessional and unethical. It also adds weight to the plausible suspicion of wrongdoing by a number of senior police officers over the mis-handling of the whistleblower allegations.

3. Section 17(1) of the Act states that if a public authority wishes to refuse any part of a request it must issue a refusal notice within the 20 working day time for compliance. No such notice was given. That is unprofessional and unethical.

Yours sincerely,

John McDevitt

Dear Nottinghamshire Police,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Nottinghamshire Police's handling of my FOI request 'Use of police logo'.

"In your reply to my request for information you say Nottingham City Council have sought and have the permission of Nottinghamshire police to use the logo for penalty charge notices"

This answer is very misleading as you have not given any evidence to say how this permission was obtained,, The FOI Act does not cover information that held in someones head, You are only allowed to provide information if it is held in a recorded form. I believe the information you have provided was done so to assist me but it is not accurate or compliant, Please provide evidence to the FOI question that you have answered ie question 1 as you have clearly stated that permission was granted and I would like to know how your came to that conclusion as I note in your reply to question 4 that it does not seek access to recorded information held by Nottinghamshire police, based on this reply by yourselves it is only right to assume your response to question 1 is therefore held in recorded format for you to be able to answer it and be compliant.

Yours faithfully,

John McDevitt

Dear Freedom of Information,
In due respect I think it may be fair to say amd quite an understatement that there may be a delay as I asked for an internal review on the 13th August and you respond today 11th September! Plus given the fact my original request for the info was made on the 11th May which makes it 4 months to the day since original my request.

I feel I have given yourselves more than enough time to deal with any delays and request that the internal review is carried out asap as the information you supplied that I have highlighted in the request for review is non compliant, I think think if the FOI request continues at this pace and non compliance I will have no other alternative than to escalate this as a complaint to the commissionaires office.

Please advise a realistic date that the review I requested on 11th August will be completed.

Yours sincerely,

John McDevitt

Dear Freedom of Information,
Today 13th November marks 6 months to the day since I originally asked for the information, Some information was given a few months ago but it was not acceptable as there was no evidence to back up what info you provided and i asked for an internal review as information stored in someone's head is not classed as data. I am still waiting for satisfactory outcome and fell 6 months and still waiting is outrageous and very unprofessional. Please bring this to a speedy conclusion as the next actions on this FOI will be to report your department to the FOI commissioner as an official complaint about the time and the way this FOI has been dealt with.

Yours sincerely,
