There is no record of your initial request ever being received. I have only now become aware of it as you have provided a link to the whatdotheyknow.com website. I do not routinely check this website.

Now that I have been made aware of your request, I will endeavour to provide the requested information, if it is available, as quickly as possible. The detail below should be helpful in answering your query.

The restriction on use of car park income only applies to on-street parking with the exception of income from off-street penalty charge tickets.

With on-street parking this Council is collecting income on behalf of Devon County Council and all the income received form on-street parking is passed directly to them. We make a charge to cover the cost of collection. I understand the County Council spend this money only on transport related items but you may wish to confirm this direct with them. The income we received from off-street penalty charge tickets, which is in the order of £75,000 a year, is used to support the running costs and maintenance of our car parks.

The income we receive from off-street parking, to which no spend restrictions apply, is used as part of the Council's overall income along with other fees and charges, government grant and council tax to support the costs of the Council in running its many services. Although the income from car parks can be equated to the costs of running specific service areas this is to demonstrate how important this income stream is to the Council, in reality total expenditure of the Council is matched by available income to produce a balanced budget for the Council.

I think Kate should take a look at section 15 of the Secretary of States Statutory guidance to local authorities on the civil enforcement of parking contraventions.

And to back that up, she should also read section 6 of the same publication.
