Response to this request is long overdue. By law, under all circumstances, Lincolnshire Fire and Rescue Service should have responded by now (details). You can complain by requesting an internal review.

Dear Lincolnshire Fire and Rescue Service,
I am writing to request an uptodate Fleetlist for Lincolnshire Fire and Rescue Service. I am have been made aware that you procured some new appliances and would like to have a full allocation list of these. This must include the following information: Vehicle Registration, Make, Model, Builder, Type and Location.
It will not be accepted that Lincolnshire FRS place the request as not in the public interest and refuse to pass this information due to National Security or following the CPNI guidance. These are public assets and Lincolnshire FRS must remember this.
It is also to be noted that the below which has come from the ICO to which the information is now allowed to be released.

A recent Decision Notice on the ICO's web site related to the
publishing of Vehicle Registration Marks (VRMs) in response to Freedom of Information
requests and, in particular, the difference between vehicles registered to individuals and
those registered to organisations. It also referenced vehicles registered to organisations but
have subsequently been sold-on and may now be registered to individuals.
‘26. The Commissioner has previously considered the status of VRM’s under the DPA 1998
and decided that where the VRM belongs to a vehicle which is owned by a living individual
the VRM itself will be personal data without associated information being disclosed with it.
This is because information identifying the owner of the vehicle is obtainable simply from
having access to the VRM."
"27. However, the Commissioner notes that where the owner of a vehicle is a corporate
body or an organisation rather than a living identifiable individual then VRM information
cannot be personal data. Section 40(2) cannot therefore apply to this information."
"29. Following on from this, a disclosure of any VRM data which refers to vehicles which
have since been sold on to private individuals would also be a disclosure of personal data,
relating to the new owner of the vehicle. A motivated individual with access to the VRM
number of a vehicle would be able to take steps to identify the current owner of that
vehicle."

I am writing to request an internal review of Lincolnshire Fire and Rescue Service's handling of my FOI request 'Updated Fleetlist'.

The request for information has been ignored and is missing half the vehicles that are in the fleet.
The below from yourselves is your response and this is not a public interest test. Section 31 can not be applied as there is photographs of these vehicles all over the internet and also on local stations social media pages. Therefore you are not complying with your own rules and in fact breaking these.

Response:
I can confirm that the information requested is held by Lincolnshire County Council. I
have detailed below the information that is being released to you.

Section 31 provides a prejudice-based exemption which protects a variety of law
enforcement interests and is subject to the public interest test. When considering a
prejudice test any precedent effects as a result of disclosure can be taken into account.
We consider that Section 31 at subsection 1 (a) is applicable in our response. Section
31(1)(a) states information can be withheld if its disclosure under FOIA would be likely
to prejudice the prevention or detection of crime.
The council has considered whether Section 31 is engaged in accordance with the ICO
guidance.
1.If the actual harm alleged would or would be likely to occur if the information was
disclosed.

2.Can it be demonstrated that some causal relationship exists between the disclosure
of information and the prejudice that is alleged and whether it real, actual or of
substance.
3.Whether the level of prejudice being relied on by the authority is met.
Whilst the councils view is that there is hypothetical possibility that this prejudice could
occur and that it may not be possible to confirm that the public are at risk, disclosure of
the information would likely be prejudice to the prevention.
Section 31 is subject to the public interest test.
The council has determined that the disclosure of vehicle registration numbers,
specifically fire & rescue vehicles could assist organised crime gangs with criminal
activities. Vehicles which may then be used to access unauthorised areas or used for
activities which would likely be a risk to members of the public. The authority further
considers that disclosure of the information could be used by criminals specifically to
clone vehicles so that they are able to bypass automatic number plate and camera
recognition systems in order to carry out criminal activities.
Section 31(1)(a) FOIA in favour of disclosing the requested information
The Council accept that there is a general presumption in favour of disclosure of
information to provide accountability and transparency and that the general public as a
tax payer are able to have access to information regarding vehicles. It is in the public
interest to know how the public funds are spent and that vehicles are maintained and
operational.
Section 31(1)(a) FOIA in favour of maintaining the exemption
The council considers the overriding safeguarding and security to the general public
and the organisation is great and should the information be disclosed that there is
potential that a criminal event would be more likely. The council considers that the
disclosure of the information may facilitate a criminal activity and that there is a clear
public interest in protecting the public from such activity.

Dear Customer Information Service,
As per the FOI request that was asked for, it as for a full updated fleetlist. As stated the excuse regarding National Security protocols in unacceptable. Members of the public have a right to know what their Fire Service have in vehicle wise.
There are plenty of photographs on Social Media of the appliances that are based at each Lincolnshire Fire Stations. Your protocols during the Covid-19 Pandemic have been constantly ignored as Lincolnshire FRS have allowed a group of individuals to photograph these appliances.
If Lincolnshire refuse under the national security then there is no point in holding open days as there will be a breach of security to show the vehicles with registrations on .
