Dear Welsh Government, it has been reported in the national media, that the Welsh Government is to introduce a 'property tax' on the people of Wales, similar to 'Stamp Duty'.

Please provide or direct me to any/all recorded documentation, which would authorise the Welsh Government to; ignore, countermand, usurp, repeal or otherwise revoke, The Petition of Right 1628 which forms part of our Constitution and is inalienable as it was bestowed by the Monarch by the grace of God.

Dear Welsh Government, thank you for your acknowledgement of my request, however its verbose and irrelevant content in no way provide a response in the context of my request, which is:

Please provide or direct me to any/all recorded documentation, which would authorise the Welsh Government to; ignore, countermand, usurp, repeal or otherwise revoke, The Petition of Right 1628 which forms part of our Constitution and is inalienable as it was bestowed by the Monarch by the grace of God.

Your communication would imply that an act or statute has the power ot authority to overrule a God give right enshrined in Common Law, which would be unconstitutional and therefore unlawful.

It is for this reason I demand a review into the handling of my request.

Outcome of an Internal Review

Dear Pat James

Complaint in respect of ATISN 10754: Property Tax

Your email requesting a review of the above was received on 21 September, and I emailed you on 22 September confirming that I would undertake an internal review. I confirmed that I would inform you of the outcome by 19 October.

I have considered your complaint in accordance with the procedure outlined in the Welsh Government's Practical Guide for Making Requests for Information (which is available by post on request or via the internet). I have confirmed that the Welsh Government does not hold any recorded documentation that falls within the scope of the request. The response to the original request alerted you to the Wales Act 2014 which provides the Assembly with the legislative competence to make provision in relation to devolved taxes, and provided a weblink to access this. The Freedom of Information Act (2000) confirms under section 21(1) that ‘Information which is reasonably accessible to the applicant otherwise than under section 1 is exempt information’. On the basis of this, I am upholding the original decision.

Interested readers:

The Petition of Right 1628 was brought against King Charles the First by Parliament (both houses) and curtailed the right of the Monarch to impose taxes...that's the Monarch, not Parliament itself, which is a kind of important point/difference.

So, in the context of the request, the Petition continues to apply as the foundation for the subsequent legislation enacted by Parliament.

So, ask yourself when was the last time any Monarch between Charles I and Queen Elizabeth II herself tried to raise taxes for themselves? For those who didn't know, It was the English Civil War and the Monarch lost.

Parliament on the other hand can raise taxes whenever it chooses to - and pass legislation as needed to assist that process, without in any way conflicting with the 1628 Petition.

It always pays to refer directly to the source to really understand something.

The essence of the Petition of Right is that only the Westminster Parliament has the authority to impose tax.

Which it did by adopting the secondary legislation devolving to the Welsh Assembly certain powers enabling that Assembly to raise its own taxes as described in the original request - without conflicting with the Petition of Right principles.

The answer to the original request would therefore be that no documentation existed authorizing the Assembly to 'ignore, countermand, usurp, repeal or otherwise revoke, The Petition of Right 1628' - because it didn't need to be ignored, countermanded, usurped, repealed or revoked.
