Dear Homes for Islington,

RE: United House Payments and Homes For Islington Legal Services

1- Homes for Islington website discloses that during the period May 2010 and December 2010, HFI Ltd made 15 payments to United House Limited totalling 424249.74. Did Hoes for Islington retain a percentage (usually three per cent or five per cent) of certified payments to the building contractor to incentivise the contractor to finish the works and remedy any defects?

2- Could you please disclose under what contract these payments were made, disclose when the contract was signed, and provide copy of the contract under which these "contractual payments" were made.

3- Please disclose if the contracted works were advertised or submitted to any competitive bidding process.

4- Please disclose the address and also full details of what works were delivered for each of these 15 payments made by Hoes for Islington.

5- During the period May 2010 and December 2010, were any other payments made to United House, if so how many payments and what was the total amount?

6- How much VAT has "Homes for Islington Legal Services" (regulated by the Solicitors Regulation Authority) been charging London Borough of Islington for each of the years 2006 to 2011, and how many VAT invoices have been issued for each of these years, and
how many of these invoices have been paid for each of the years 2006 to 2011?

7- How much is the estimated amount amount in VAT charges for works by "Homes For Islington Legal Department" that has not yet been invoiced to Islington Council and paid to Inland Revenue; and do Homes for Islington's Annual Accounts disclose the billing amount and applicable VAT for works by "Homes For Islington Legal Department" that has not yet invoiced to its client, ie Islington Local Authority?

These payments were made under the provisions of the LBI Housing PFI 1 and 2 contracts. The PFI 1 contract was signed on 31st March 2003 and the PFI 2 contract was signed on 15th September 2006. A copy of the PFI 2 contract is attached. Some information in this contract is commercially sensitive and therefore redacted versions have been made available under the Freedom of Information Act.

3- Please disclose if the contracted works were advertised or
submitted to any competitive bidding process.

Both PFI contracts were awarded following European Union Works directive (93/37/EEC) and the Public Works Contracts and Regulations 1991 ( S1991 No. 2680 ) which was subject to advertisement in the Official Journal of the European Union and subject to a competitive procurement process.

4- Please disclose the address and also full details of what works
were delivered for each of these 15 payments made by Hoes for
Islington.

Details and addresses of the 15 payments made to United House are attached. Deconversion is the enlargement of smaller flats into larger homes.

5- During the period May 2010 and December 2010, were any other
payments made to United House, if so how many payments and what was
the total amount?

These were the only payments made.

6- How much VAT has "Homes for Islington Legal Services" (regulated
by the Solicitors Regulation Authority) been charging London
Borough of Islington for each of the years 2006 to 2011, and how
many VAT invoices have been issued for each of these years, and
how many of these invoices have been paid for each of the years
2006 to 2011?

Legal Services is not billed for separately, but included within our management fee and the VAT in respect of the Legal Services is therefore included in the above figures which represents the VAT on management fee invoices.

invoiced to Islington Council and paid to Inland Revenue; and do
Homes for Islington's Annual Accounts disclose the billing amount

VAT on amount not invoiced yet: £1,246,698. As stated above the VAT on the Legal Services relates to the management fee in total and is therefore included in the VAT figure above. HFI's Annual accounts reflect the unbilled amount as accrued income, however the VAT will only be reflected when the invoice is raised.
