Dear Aberdeen City Council,

My questions concern Union Terrace Gardens

1. How many retail/catering/commercial units will be created? Please list including location (ie the tramshed-type space near the corner of Union Terrace and Union Street) giving square footage

2. Which of the retail/catering/commercial units are already leased and to what business/company? EG it is locally understood that 'Books and Beans' and 'Maggies' are taking up space.

3. What is the lease on a monthly basis for all properties listed in Question 1 above?

4. As is the case at Marischal Square, will the city be paying 'sweeteners' - eg rent-free periods or other perks of value to those taking spaces?

5. In the case where food premises are involved as lesees, what entity will be responsible for keeping UTG free of food waste, wrappers, bags etc - the city or the business?

Thank you very much for your emails and please accept our sincerest
apologies for our delay in responding to you. We have completed the
necessary search for the information requested and our response is now
detailed below.

My questions concern Union Terrace Gardens

As at the date of your request (9 April 2022):

1. How many retail/catering/commercial units will be created? Please list
including location (ie the tramshed-type space near the corner of Union
Terrace and Union Street) giving square footage

No more units are planned to be created.

Under our duty to provide advice and assistance, we would like to advise
that the following three individual Pavilion units have already been
constructed:

Rosemount Pavilion, on Union Terrace across from His Majesty’s Theatre.
Area of 740 sq ft or thereby

Burns Pavilion, on Union Terrace adjacent to the Robert Burns statue. Area
of 2,200 sq ft or thereby

Union Street Pavilion, at the junction of Union Street and Union Terrace.
Area of 8,041 sq ft or thereby

2. Which of the retail/catering/commercial units are already leased and to
what business/company? EG it is locally understood that 'Books and Beans'
and 'Maggies' are taking up space.

None of the above Pavilion units have already been leased.

Under our duty to provide advice and assistance, we would like to advise
that the Burns Pavilion and Union Street Pavilion are still available for
lease. The Rosemount Pavilion is currently under offer and has not yet
been leased.

3. What is the lease on a monthly basis for all properties listed in
Question 1 above?

This information is not held.

The Pavilions are currently being marketed by external agent FG Burrnett
(chartered surveyors), with the Burns Pavilion and Union Street Pavilion
still available and the lease terms for the Rosemount Pavilion still to be
negotiated between the parties.

We are unable to provide you with information on what is the lease on a
monthly basis for all properties listed in Question 1 above as it is not
held by ACC. In order to comply with our obligations under the terms of
Section 17 of the FOISA, we hereby give notice that this information is
not held by us.

Under our duty to provide advice and assistance, we would like to advise
that the quoted rents for the units that are still available (Burns
Pavilion and Union Street Pavilion) are:

Burns Pavilion - £2,500 per month

Union Pavilion - £7,500 per month

4. As is the case at Marischal Square, will the city be paying
'sweeteners' - eg rent-free periods or other perks of value to those
taking spaces?

Yes - lease terms will be in line with commercial market practice and may
include tenant incentives, depending on the outcome of negotiations
between ACC and those taking spaces.

5. In the case where food premises are involved as lessees, what entity
will be responsible for keeping UTG free of food waste, wrappers, bags etc
- the city or the business?

Tenants of the Pavilion will be responsible for the demised area granted
under their lease to keep the units neat and tidy. The wider Union Terrace
Garden area will be under the management of the Council.
