Dear United Kingdom Atomic Energy Authority,

BACKGROUND:
By a contract agreed between UKAEA and Manor Farm (Chilton) Limited dated 28th October 1954 the UKAEA purchased land (from Manor Farm) and the parties further agreed to the terms of a Restrictive Covenant preventing the existing and future owners / occupiers of land adjacent or close to the land purchased by UKAEA from constructing any structure (permanent or temporary) on that outpouring land (or any part thereof); AND in another contract agreed between William G. Bosley and others and The UKAEA dated 11th August 1955 where pursuant to the said contract, the parties agreed to a Restrictive Covenant identical in nature (to use land close to the UKAEA land for agricultural purposes only and to not erect any structure etc.)

REQUEST:
What is the extent of the Restrictive Covenants in place now please? By which I mean; will you disclose a map or plan detailing the land owned by The UKAEA and detailing the land that is subject to the covenants requested by The UKAEA in 1954 and 1955 as shown in the background as above?

Yours faithfully,

Darryl J Lee (Mr.)

Darryl J Lee (Mr.)

Dear Enquiries, FOI,

Having waited patiently for your reply; I am disappointed at your response.
You ask me to believe that an organisation as important as The UK AEA does not know where the limits of its own land lie.

I have copies of a great number of "Title Deeds" to land in the vicinity of the Harwell Campus. This is where I obtained details of the Covenants from (The subject of my FOIA request). Rather worryingly, no "Title Plans" appear to exist (in the custody of Her Majesty's Registrar) and also, it would appear in the hands of the "Owner(s)" of the Covenants ("UKAEA").

I feel it my duty to require an internal review of your response to my request not-least because without the geographical limits of the Covenants being identified, the UKAEA can not seek to restrict any construction works on land that might be physically adjacent to land owned by UKEAE and perhaps leased to The NDA (by UKAEA) and therefore potentially being land subject to the Covenants about which I ask but could even be land that is rightfully-owned by UKAEA or NDA (apparently without either even knowing - which sounds unbelievable given the legal duties surrounding the nuclear industry and National Security - which without such information may pose a risk).

I ask for an internal review.
Please supply a "site plan" or map or equivalent showing the extent of all Covenants held / owned / enforced (or capable of being enforced) by The UKAEA plus any easements that remain in force today that are within 5000 Meters to the East of the Newbury Road "Boundary" of the Hawell Campus.

Yours sincerely,

Darryl J Lee (Mr.)
