UK Law that states i have to pay council tax ?
Dear Sir/Madame,
I was recently advised that there is no law in the United Kingdom that states i have to pay council tax, therefore it would be a fair request to ask to stop my direct debit that i currently have set up with Rochdale Council ? I have researched the matter extensivley so please don't try to insult my intelligence by coming at me with treaties or directives, because they mean nothing, there is no legal requirement therefore can i request not to pay?
Thank you
Thank you for your email, it has been passed to the relevant department
who will reply to you direct.
Dear Sir or Madam,
I’m afraid you have been badly informed and I would advise you not to
cancel your direct debit.
Council tax is a statutory tax based on the occupation of domestic
property levied by billing authorities, as required by the Local
Government Finance Act (LGFA) 1992, on residents or owners of dwellings to
raise funds to pay towards local authority services.
Inclusion of a dwelling in the billing authority's domestic valuation list
compiled by the Her Majesty’s Revenues & Customs Valuation Office Agency
determines that a property is a chargeable dwelling.
Liability for council tax is determined by Section 6 of the LGFA 1992
which states that where a dwelling is occupied the council tax is payable
by the resident based on a prescribed hierarchy of liability. If you
should wish to research this further the legislation is freely available
on the Office of Public Sector Information website - www.opsi.gov.uk
