Please can you send me a excel list of all UK care homes, with their name, email address and website?

I write in response to your correspondence of 6 August 2020 in which you
asked for the following information:

 

“Please can you send me a excel list of all UK care homes, with their
name, email address and website?”

 

CQC is the regulator for health and social care for England.  We do not
hold information about care providers in other countries of the UK.  You
will need to contact their care regulators directly.

We regularly publish information about registered services on our website.
You can obtain the list by going to our website using the link below:

Scroll down the page until you find the spreadsheet under the heading ‘CQC
care directory - with filters.’ This is updated monthly. To filter the
spreadsheet to only show care homes, please indicate ‘Y’ in column ‘C’.
Column ‘H’ lists website addresses.

 

Please note that the spreadsheets do not contain e-mail addresses as they
do not form part of our register. E-mail addresses are provided to us with
an expectation of confidentiality. We do, however, publish links to
websites (as mentioned above) which can be used to find contact e-mail
addresses where providers have chosen to publish them on their websites.

 

We also attach a formal note, giving a more detailed explanation for
withholding email addresses. This explains why the information is exempt
from disclosure under the Freedom of Information Act 2000 (FOIA) and your
right to challenge this decision if you are unhappy with it.

I write in response to your correspondence dated 8 August 2020 in which
you asked us to review our response to your request for information.

 

Your original request under the Freedom of Information Act 2018 (FOIA) was
received on the 6 August 2020 and was responded to on 7 August 2020.

 

In your request for a review you wrote:

care homes in the UK via email.”

 

Please accept our apologies for the delay in responding. Your request has
been processed in accordance with our internal review procedure for
requests made under information legislation. Our response to the review is
given below.

 

In conducting the internal review, I have considered whether we have
complied with our obligations under FOIA and if we can provide you with
the requested information.

 

Under section 1 of FOIA, CQC is required to confirm whether it holds
information. I am satisfied that we did this. We are also required to
supply a copy of the requested information or state any exemptions relied
upon to withhold the requested information by way of a refusal notice. I
am satisfied that we did this.

 

CQC must also issue a valid response within 20 working days. Your request
was received on 6 August 2020, and responded to on 7 August 2020, meaning
our response was issued 1 working day after receipt.

 

I can confirm that we will not be upholding your request for email
addresses. As explained to you in the initial response, when the email
addresses are provided to CQC it is with an explicit expectation that CQC
will only use this information for the purposes of registration and
compliance. Furthermore, we do not have consent to release this data and
to do so without consent would be a breach of the data subjects rights
under GDPR.

 

Section 41(FOIA) applies where information has been obtained from any
other person or organisation and where disclosure could constitute an
actionable breach of confidence. It does not have to be information that
identifies an individual to be considered confidential.

Our website [1]privacy statement advises that we “treat information we
receive from the public, professionals and others as confidential”

 

The email addresses that we hold are not “public data” and there is no
automatic entitlement to this data under FOIA. Whilst FOIA creates a duty
for public authorities to provide information on request, there are
prohibitions on disclosure created by other legislation.

 

I am therefore upholding the application of the following exemptions under
FOIA: - sections 41(1) (information obtained in confidence) and 21(1)
(information accessible to you by other means).

 

Further appeal

 

If you do not feel that CQC has complied with our responsibilities under
the Freedom of Information Act 2000, you may make a complaint to the
Information Commissioner’s Office (ICO) under section 50 of that Act. You
can find out more about your rights on the ICO website.
