I am writing to request an internal review of Department for Work and Pensions' handling of my FOI request 'UC Health Checks and Project Assessment Review Reports'.

Thank you for your response and the disclosed information.

I note the Department’s reliance on section 22 to refuse the remainder of my request. Unfortunately, the Department’s own response is proof that it is unable to rely on section 22 to refuse disclosure, as it clearly doesn’t not have a settled intention to publish the requested information.

The Department has also failed to comply with its obligations under section 1(a) FOIA in respect of my RFI2. This covers:
“- Other PARs and Health Checks, not listed above, that were completed by the IPA during the period 01 April 2017 to 31 March 2019”.

The Department is required to confirm the information it holds that falls within the scope of my request. This means it must tell me what PARs and health checks exist that fall within the specified timeframe. It cannot simply say that it is refusing to disclose information without telling me what it is actually refusing to release. This prejudices my ability to challenge the Departments reliance on section 22 and must therefore be considered unlawful.

I note the Department’s attempt at a public interest test. Unfortunately, as is so often the case, it fails the test set out in the binding case of Department of Health v ICO & Lewis [2015] UKUT 159 (AAC).

This states disclosure under FOIA should be approached on a contents, specific information, basis and not a class basis ([19]-[21]).A contents based assessment must show that the actual information is an example of the type of information within the class description of an exemption and why the manner in which disclosure of its contents will cause or give rise to risk of actual harm to the public interest, and evidence which does not address this is flawed ([29]-[30]).

The Department’s response is clearly a class-based response. This is supported by its attempt to impose a 3 year moratorium on disclosure. It would hard to construct something that demonstrates a class-based approach than yet another blanket ruling imposed by the Department.

Dear Department for Work and Pensions,

The Information Commissioner issued her DN (case reference: IC-46647-Y7R2) today. She found that the DWP cannot rely on sections 22, 35 or 36 to refuse disclosure. I would be grateful if the DWP disclose the remaining requested information without further delay. Given the age of the requested information it is not in the public interest for the DWP to appeal the DN to the FTT.

The Commissioner issued her decision notice (IC-46647-Y7R2) stating that the DWP cannot rely on sections 22, 35 & 36 to refuse disclosure.

Now waiting to see if the DWP appeals the DN. If it acts true to form it will appeal to the FTT.

ICO notified me today that once again the DWP has appealed a decision notice that doesn't agree with its use of section 22. Appeal case reference is EA/2021/0118.
