Dear South East Coast Strategic Health Authority,

I am advised by Sussex Partnership Trust that on 17 February 2010, NHS South East Coast announced that they
will be conducting an independent investigation into the care and treatment of Samuel Reid Wentworth, and they will be able to provide you with further details about this process.

In seeking answers under FOI:

Please advise:

What type of independent investigation has been commissioned?

·Is it under Health Service Guidelines, with particular ref to HSG(94)27?

·Is it under SHA SUI policy guidance?

·Or?

Please can you tell me the likely publication date?

Will the Investigation Report be published online and please can I have a copy of the finalized Report…anonymised if necessary?

Sussex Partnership Trust have been asked for a copy of their internal review report too as indicated publication in media.

"Sussex Partnership has already commissioned an independent review of the care and treatment provided by the Trust to Samuel Reid Wentworth, and has shared the findings of this review with the families involved and the media."

Thank you for your Freedom of Information Act request received
on 18 February, regarding a mental health incident. Please accept
my apologies for the delay in replying.

You asked NHS South East Coast, the strategic health authority
(SHA) for Kent, Surrey and Sussex, to provide the following
information:

o What type of independent investigation has been commissioned
into the care and treatment of a particular service user?
(Please note, I have not included the individual's name in this letter
for the sake of confidentiality.)

NHS South East Coast confirmed on 17 February 2010 that we have
decided to commission an independent investigation into the care
and treatment of the patient involved in this case.

Independent investigations commissioned by NHS South East Coast
vary according to the scale and nature of the incidents and the
seriousness of the issues investigated. They also take into
account the public interest in ensuring services are as safe as
possible or where they need to be improved, ensure that an
action plan is agreed, embedded in the organisation and its
progress monitored by the SHA.

The investigation into this case will take the form of a review
by an expert clinical panel, which will use Sussex Partnership
NHS Foundation Trust's own independent investigation into this
incident as its starting point, to examine the care and
treatment provided by the NHS to the individual concerned.

The investigation will further focus on the Trust's action plan,
arising from the internal review, to ensure it is fully
implemented, and that there is evidence of improvement and that
any lessons have been learned.

o Whether the investigation is being conducted under Health
Service Guidelines, with particular reference to HSG(94)27, or
whether it is being conducted under SHA policy guidance on
serious untoward incidents

This investigation will be commissioned in line with NHS South
East Coast Guidance for Mental Health Independent Investigations
(November 2009). A copy of this guidance can be found on our

This document outlines the process for undertaking an independent
investigation following a serious untoward incident (SUI) which
fulfils the criteria set out in the National Health Service
guidance known as HSG 94(27).

o The likely date of publication of the independent
investigation report

A written report that includes recommendations to NHS South East
Coast will be published on the SHA's website at
[2]www.southeastcoast.nhs.uk once the investigation is completed in
order that lessons learned may be shared more widely within the
NHS and among partner organisations. A date has not yet been
set for this.

o Whether the investigation report will be published online

Many thanks for your recent response and I note in your letter that "The investigation into this case will take the form of a review by an expert clinical panel,which will use Sussex Partnership NHS Foundation Trust's own independent investigation into this incident as its starting point, to examine the care and treatment provided by the NHS to the individual concerned."

Surely the term "Sussex Partnership NHS Foundation Trust's own independent investigation" indicates that the initial investigation is NOT independent! Will the SHA investigation be also addressing service provision failures which possibly affected the care and treatment of the individual concerned?

mental health incident.

Your letter to NHS South East Coast, the strategic health
authority (SHA) for Kent, Surrey and Sussex, asked the following:

Surely the term "Sussex Partnership NHS Foundation Trust's own
independent investigation" indicates that the initial investigation
is not independent! Will the SHA investigation be also addressing

treatment of the individual concerned?

NHS South East Coast can confirm that the initial review
commissioned by Sussex Partnership NHS Foundation Trust was
undertaken by a panel that included an external independent
Chairman and two other external experts, as well as an internal
member of the Trust.

The expert clinical panel commissioned by the SHA to subsequently
look at this case will review the Trust's own investigation and
report, but will also explore and analyse the systems and
processes that the Trust has in place for assuring that practice
is safe, appropriate and meets best practice standards. The
review commissioned by the SHA will also address any other
relevant issues that arise out of the investigation.
