TVGs processed against Planning Inspectorate opinion

Dear West Berkshire Council,

Under the Freedom of Information Act I request the following information:

1. How many Town and Village Green (TVG) applications has this local authority (LA) dealt with since 19 July 2006. Or if this not possible to obtain then the best you can do, but please specify the period of the search.

2. Of these TVG applications returned in 1, for how many was the Planning Inspectorate's opinion that the TVG application was excluded? In other words that a trigger event had occurred with no closing event.

3. Of these TVG applications returned in 2, for how many did the processing of the TVG application continue, in other words the LA ignored the Planning Inspectorate's opinion that any TVG application was excluded.

4. For the TVG applications returned in 3, please supply details of location, LA decision on the application and any appeal details i.e. court reference and outcome.

Electronic versions of documents are acceptable and preferred.

Please see below the Council’s response to your request for information.

 

You have asked;

 

1. How many Town and Village Green (TVG) applications has this local
authority (LA) dealt with since 19 July 2006. Or if this not possible to
obtain then the best you can do, but please specify the period of the
search.

 

The Council have received two applications both in 2006;  one was refused
by a Hearing and the other was accepted by WBDC

 

Reference given to each application was VG103 Linnet Close Tilehurst and
VG104 Peaemore

2. Of these TVG applications returned in 1, for how many was the Planning
Inspectorate's opinion that the TVG application was excluded? In other
words that a trigger event had occurred with no closing event.

 

The matter was referred for a hearing set up by WBDC with a Senior
Barrister present as the criteria was not sufficiently strong for a
village green to be agreed.

3. Of these TVG applications returned in 2, for how many did the
processing of the TVG application continue, in other words the LA ignored
the Planning Inspectorate's opinion that any TVG application was excluded.

4. For the TVG applications returned in 3, please supply details of
location, LA decision on the application and any appeal details i.e. court
reference and outcome.

 

As mentioned in 1 above  the matter was refused as no evidence was
supplied that the area was a village green .  No appeal was made by the
Applicants.

Dear foi,

Thanks for the complete information.

FYI Commons Act 15C which Q2, Q3 relate to only came in in 2013 and not 2006 as I thought when I made this FOI. Hence you had no requirement to contact Planning Inspectorate. My mistake in using 2006 instead of 2013.
