TVGs processed against Planning Inspectorate opinion

Dear Slough Borough Council,

Under the Freedom of Information Act I request the following information:

1. How many Town and Village Green (TVG) applications has this local authority (LA) dealt with since 19 July 2006. Or if this not possible to obtain then the best you can do, but please specify the period of the search.

2. Of these TVG applications returned in 1, for how many was the Planning Inspectorate's opinion that the TVG application was excluded? In other words that a trigger event had occurred with no closing event.

3. Of these TVG applications returned in 2, for how many did the processing of the TVG application continue, in other words the LA ignored the Planning Inspectorate's opinion that any TVG application was excluded.

4. For the TVG applications returned in 3, please supply details of location, LA decision on the application and any appeal details i.e. court reference and outcome.

Electronic versions of documents are acceptable and preferred.

Thank you for your request for information under the Freedom of Information Act 2000.

The Council would respond to your enquires, using your questions as headings for its responses, for ease of reference, as follows:

1. How many Town and Village Green (TVG) applications has this local authority (LA) dealt with since 19 July 2006. Or if this not possible to obtain then the best you can do, but please specify the period of the search.

The Council's records which are available suggest during the period referred to in your enquiry the Council have dealt with 5 application to register a Town or Village Green.

2. Of these TVG applications returned in 1, for how many was the Planning Inspectorate's opinion that the TVG application was excluded? In other words that a trigger event had occurred with no closing event.

The available records give no indication of whether trigger events and closure events formed any part of the consideration for or against registration.

3. Of these TVG applications returned in 2, for how many did the processing of the TVG application continue, in other words the LA ignored the Planning Inspectorate's opinion that any TVG application was excluded.

4. For the TVG applications returned in 3, please supply details of location, LA decision on the application and any appeal details i.e. court reference and outcome.

The locations are referred to in the available records as (1) Castleview Green, Castleview Road (2) Wexham Park Village Green, Norway Drive (3) Toll House Green (4) Upper Lees Road Recreation Ground and (5) Green/Play Area By Tower/Ashbourne Houses, Chalvey.

With regard to Castleview Green, the record does not show the outcome of the application. It is assumed that the application was refused and either there was no appeal, or any appeal was refused, because there is no record of a registration in the Local Land Charges Registers.

With regard to Wexham Park Village Green, the record does not show the outcome of the application. It is assumed that the application was refused and either there was no appeal, or any appeal was refused, because there is no record of a registration in the Local Land charges Registers.

With regard to the Toll House Green, the record does not show the outcome of the application. It is assumed that the application was refused and either there was no appeal, or any appeal was refused, because there is no record of a registration in the Local Land Charges Registers.

With regard to the Upper Lees Road Recreation Ground, the application was refused and there was no appeal.

With regard to the Green/Play Area by Tower/Ashbourne Houses, Chalvey, the application was refused following the holding of an independent advisory enquiry by senior counsel. There was no appeal.

Thank you for the information. Can I ask if the 5 TVG applications were all prior to 2013? My mistake I'm afraid as Commons Act 15C which is the reason for Q2 was only added in 2013.

The 5th, the Chalvey Village Green application, was received in January 2015.
