Under the Freedom of Information Act I request the following information:

1. How many Town and Village Green (TVG) applications has this local authority (LA) dealt with since 19 July 2006. Or if this not possible to obtain then the best you can do, but please specify the period of the search.

2. Of these TVG applications returned in 1, for how many was the Planning Inspectorate's opinion that the TVG application was excluded? In other words that a trigger event had occurred with no closing event.

3. Of these TVG applications returned in 2, for how many did the processing of the TVG application continue, in other words the LA ignored the Planning Inspectorate's opinion that any TVG application was excluded.

4. For the TVG applications returned in 3, please supply details of location, LA decision on the application and any appeal details i.e. court reference and outcome.

INFORMATION REQUEST ACKNOWLEDGEMENT
 
Thank you for your request for information received on 16th August 2020.
 
Your request is being considered in accordance with the Freedom of
Information Act 2000 and, subject to the points made below, we will aim to
provide the information requested as promptly as possible within the
statutory timescale of 20 working days. Please note however that, at this
time,  Portsmouth City Council is focusing resources on ensuring essential
services continue to run during the Coronavirus pandemic and there may
therefore be a delay.
 
If we need to obtain clarification from you to help us understand what
information you require, we will contact you as soon as possible. If this
is the case, the 20 working day time limit will not begin until the
necessary clarification has been received.
 
The Act defines a number of exemptions that may prevent release of certain
information.  The Council will consider whether any of these exemptions
apply and, where required by the Act, will carry out a Public Interest
Test to decide whether information should be disclosed. If any information
is to be withheld, we will explain which exemption applies. If a Public
Interest Test is required, we will be entitled to extend the 20 working
day time limit by a further reasonable period (of not more than another 20
working days) and will inform you if this is the case.
 
 
The Council’s standard approach is to provide the information in the form
in which we hold it.  If you require an alternative format, for example,
an audio file, large print or information in a different language, please
let us know and we will provide it if reasonably practicable to do so.
 
There may be a fee payable for providing the information, for example, if
the cost of complying exceeds the appropriate limit set out in Section 12
of the Act or for photocopying or postage.   If a fee is to be charged, we
will send you a Fees Notice. Any fee must be paid before the information
will be provided.  The time between the issue of the Fees Notice and
receipt of payment will be excluded from the calculation of the 20 working
day time limit.
 
Any personal information you provide us with will only be used to enable
us to comply with your request.

A Town and Village Green (TVG) application was received for Port Solent
Village Green in December 2010. This application was refused in November
2012.
 
Please find attached the Planning Inspectorate's Report for this TVG
application.
Please note that names and personal details of third parties have been
redacted from disclosure on the basis that this is personal data.
 
Portsmouth City Council believes that this information is exempt from
disclosure in accordance with Section 40(2) of the Freedom of Information
Act. The information we hold such as names, addresses and other personal
details of individuals in the report is personal data as defined by the
General Data Protection Regulation.  This information is not typically
already in the public domain. We do not therefore believe it would be
their reasonable expectation for us to do so and disclosure would cause us
to breach the First Principle of the Data Protection Act.  On this basis,
we are unable to disclose this information as part of your request.  
  
In accordance with the Freedom of Information Act section 17 this email
acts as a parital Refusal Notice. We apologise that your request will not
be met in full, however, if you have any further information needs in the
