Section 8(1) of the FOIA sets out the requirements of a valid request for information and provides that a request must, amongst other things, “state the name of the applicant and an address for correspondence”. The council is happy to consider your request however in order to process the request in accordance with the Act and the requirements of Section 8(1)(b) please provide your full name.

Thank you for your request regarding Tree Preservation Orders.
 
Your request has been identified as falling within the scope
of Environmental Information Regulations 2004 and as such is exempt from
the Freedom of Information Act 2000, under Section 39 of the Act.

As when responding to an FOI request, we will send you a full response
within 20 working days, either supplying you with the information you
require, or explaining to you why we cannot supply it. However, under the
EIR Act, the provision exists to extend the response time to 40 working
days, if the request is felt to be particularly complex or voluminous.
Should this be the case, we will of course notify you in good time. 

The due date is 25 July 2017. If we need any further clarification or
there is a problem, we will be in touch. 

In the meantime if you wish to discuss this further please contact me. It
would be helpful if you could quote the reference number quoted above.

Thank you for your email, and I am pleased to see that you are happy with
the response.

With regard to the data accuracy, I have spoken to Mr Dale and he tells me
that as far as Cheshire East Council is concerned the data on TPOs is
updated very regularly. In fact, once a TPO is confirmed, the data is fed
onto their system within 24 hours.

The links to the sites you give below are Government ones, so it is
difficult to comment on how up to date these are, but we would assume that
they are updated regularly in line with our system.

Please be aware however, that there is a disclaimer on our webpage
(underneath the link to making a TPO application) advising that the data
should not be used for legal or conveyancing purposes, as no guarantee can
be given as to its accuracy.
