Please provide the number of applications made under the requirement for Chief Officers (or former Chief Officers) to provide notification of their post-service employment within 12 months of them leaving the police service for each financial year (as designated from 1 April to 31 March) from 2018 to 2022 inclusive. I am writing to request an internal review of Metropolitan Police Service (MPS)'s handling of my FOI request 'Transparency data for applications made under the requirement for Chief Officers (or former Chief Officers) to provide notification of their post-service employment'.

I am confused by the response from the MPS to my request which is simply asking for the same information which the MPS is required to publish by the Home Office, as per the guidance I cited in my original request.

You have applied a legitimate interests test, but I believe it should be challenged.

I do not believe the information under request can be reasonably withheld under section 40(2), due to the requirement as set out by the guidance I cited from the Home Office. Transparency data is required in order to maintain public trust in the integrity of the MPS and to hold accountable those who held Chief Officers-level ranks during and after their time in service. Senior officers therefore cannot expect this information to not enter the public domain if the expectation has been set by the government that it will be published.

Furthermore, when the legitimate interests test has been applied in other circumstances, it has noted the seniority of the individuals in question. In the instance of the tribunal of The Corporate Officer of the House of Commons v Information Commissioner and Norman Baker MP (EA/2006/001 5 & 001 6), the tribunal found that the "legitimate interests of members of the public outweigh the prejudice to the rights, freedoms and legitimate interests of [the data subjects]" due to "their public role". The same interests apply to those at the grades at DCC and ACC due their senior roles and the requirement for public accountability, which is why the Home Office guidance notes their seniority, defined which grades are affected, and mandates for their publication.
