Dear Sir or Madam,

Thank you for publishing your spend data here:https://www.cnwl.nhs.uk/about-cnwl/plann... . However, I notice that you haven't published any spending data since January 2019.

I'd like to make a request under the Freedom of Information act for all transactions over £25,000 from February 2019 to at most a month in arrears from the date at which you publish in response to this request.

Please provide the data in a machine readable format (preferably csv). As a minimum, please make sure to include the date, value and recipient of each transaction. Please also provide details on the procurement category of each transaction if you have it.

Dear Dora Homoki,

Thank you for your freedom of information request.

We intend to publish the data covering Feb 2019 - Present Day in due course. We are currently in the process of collating this data and documents and these documents will then be published.

This means the information 'Feb 2019 - Present Day' is being withheld pursuant to section 22 of the FOIA, as it is ‘being held for future publication’. Section 22 of the Act states that information is exempt from disclosure in response to an information request if:

“(a) the information is held by the public authority with a view to its publication, by the authority or any other person, at some future date (whether determined or not),
(b) the information was already held with a view to such publication at the time when the request for information was made, and
(c) it is reasonable in all the circumstances that the information should be withheld from disclosure until the date referred to in paragraph (a).”

The exemption at section 22 is qualified by the public interest test, meaning that the information should be disclosed if the public interest in the maintenance of the exemption does not outweigh the public interest in disclosure.

In this case the public interest factors in disclosing the information are:

Providing information regarding all transactions over £25,000 from February 2019 to at most a month in arrears from the date at which you publish in response to this request.

The factors in withholding the information are:

CNWL has a history of publishing this information on a periodic basis and has committed to publishing datasets which will include the relevant information in the near future.
Earlier disclosure is not necessary to satisfy any pressing public interest at the present time.

Dear Central and North West London NHS Foundation Trust,

On 13 May 2019, I sent you a FOI request for your expenditure over £25,000 from February 2019 to present.

On 13 May 2019, you refused my request citing Section 22 of the FOI Act as grounds for an exemption.

However, the guidance for publishing spend data for government departments states:
2.10 Spend is to be published one month in arrears, ie by the last working day of the month following the month to which the data relates. If the data is available before the end of the month, it should be published as soon as the department has cleared it for release. This data is to be published in individual monthly files.
2.11 You should not hold up the publication of your data where you have unresolved individual queries. You should publish the cleared data within the publication timescales, and amend the data at a later date if necessary. See section 2.5 for further detail on applying redactions to the data.

This means that the data requested should already be published. For this reason, I would like to request an Internal Review of the initial response to my Freedom of Information request.
