Traffic regulation order

sean kirby made this Freedom of Information request to East Riding of Yorkshire Council This request has been closed to new correspondence. Contact us if you think it should be reopened.

The request was successful.

Dear East Riding of Yorkshire Council,
You are currently carrying out road works outside Airmyn tip.
Airmyn Road is the venue, bordering the A614 Rawcliffe Road.
You are displaying 20mph speed limit signs.
I have contacted you, seeking the relevant traffic regulation order TRO. Your staff state there isn't one.

Please supply a copy of the order or state why you are breaking the law.

The Dept of Transport says:

All traffic signs and road markings placed on a public highway must be either prescribed in the Traffic Signs Regulations and General Directions 2016, as amended, (TSRGD) or authorised by the Secretary of State. It is the duty of your local highway authority to manage the road network in its area and they are free to make their own decisions about the streets under their care without reference to the Department. To take your example the speed limit signs would require TROs as set out in TSRGD.

Yours faithfully,

sean kirby

Dear East Riding of Yorkshire Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of East Riding of Yorkshire Council's handling of my FOI request 'Traffic regulation order'.

Your reply is irrelevant to my question.
I asked about the 20mph limit imposed on Airmyn Road, Goole, immediately outside your tip.
Your reply relates to different locations.
Please undertake an internal review.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/t...

Dear Mathew Buckley,

The order you have shown is a prohibition order.
Although the road I ask about is listed as "open 20" that is not what is required by law, as you know.
The final page of the order explains exactly what prohibition means and how it applies to the list of roads where vehicles are prohibited.
Kindly display the relevant TRO where you have reduced the speed limit on Airmyn High Street.

Yours sincerely,

sean kirby
