Dear Mr Stuart

I refer to your undernoted email, sent to the Ayrshire Roads Alliance. Your information request is being progressed by South Ayrshire Council's FOI Team, and as such your email has been passed to my service. I would confirm we have received your request. Our reference is EIR/2021/2620 if you need to contact us direct further.

At the present time, my team are awaiting information from the Ayrshire Roads Alliance, and have issued several reminders to them. I have again today issued another reminder to ARA and would hope their response will be forthcoming very soon. I appreciate that we have failed to meet the 20 working days time scale for providing the response to you, and I would apologise for the delays you are experiencing.

Can you please advise if under the circumstances you still wish me to proceed with an internal review at this stage, or if you would (1) wish to await on the Council receiving the ARA data to allow us to issue the formal response, at which point you could then of course ask for a review of the handling of your request, which can also consider any concerns you have about the actual response itself or if (2) you wish me to continue with a review at this stage.

If you could advise me if you wish me to start a Review, that will allow me to know how best to proceed at the present time.

Regards
Deborah McVey

Good morning

Your undernoted email has been passed to SAC's FOI Team. Please respond on any further FOI enquiries you have regarding this matter to this email address.

My records show we issued two different EIR responses to you on 26 March under EIR/2021/2620 and EIR/2021/2621. Can you please advise if you have now received these safely. If not, I will of course be happy to re-issue them to you. I look forward to hearing from you. If of course you also wish a formal review to be undertaken, please let me know which request this relates to and on what specific basis.

As ARA do not administer the FOI requests, and to avoid any delays in assisting you further, can you please ensure future correspondence is issued to this email address.

Kind Regards
Deborah McVey

Dear FOI,

I submitted 3 requests for information on 07 Feb 21. I have successfully received the information on 2 of the requests, and the what do they know.com website was updated accordingly to reflect this - marked SUCCESSFULL. I still have 1 outstanding request which is headed "Timber Transport consultation for Forests in the Barr Village Area in South Ayrshire". I have not received any information relating to this request made on 07 Feb 21. I have requested an internal review as there is clearly something going wrong with the process as laws are being disregarded or ignored.

Please note that I am M Stuart and NOT Mr Stuart.

Yours sincerely,

M. Stuart

Good evening

Thank you for your email. Your request was not received by my team from the Ayrshire Roads Alliance, only the two detailed below.

I cannot say exactly why at this stage we do not have this third request, as I do see from your What Do they know site the request was made to ARA on 7th February. I am of course happy to get this logged and dealt with as urgently as possible. Can please advise if you wish this progressed as a new request (which then gives you a right to have an internal review after you receive the response) or if you wish to be take this straight to Internal Review (where I can review the circumstances of my team having not received your request from ARA, and provide the information ARA hold, but I will not be able to review the actual information provided). Also, can you please confirm the wording I have here is for the request that we have not received:

Dear Ayrshire Roads Alliance,

Please provide details of the consultations processes which took place prior to any timber extractions being approved for the following forests near the B734 in Barr Village from Jan 2000 till Feb 2021

1) Lambdoughty Forest
2) Pinclanty Forest

3) start times, stopping times for each day of the week during extraction operations
4) total number of vehicles to complete each extraction

Furthermore, please clearly describe all enforcement powers that ARA have in relation to enforcing the agreements created during these consultations.

Please accept my apologies for any miscommunication made on my part when trying to assist, I had anticipated this was dealt with under EIR/2021/2620 and I should have fully checked the response that was issued which would have clearly shown it was not, and in fact this request had not reached my team. I look forward to hearing from you.

Deborah McVey
